Land squabble getting ugly

RYE -- A Hampton Falls couple, apparently protesting a decision by the Rye Zoning Board of Adjustment, are angering town officials and neighbors of a property they own in town.
Russell and Paula Hilliard own a small lot at 41 Ocean View Ave. Building Inspector and Code Enforcement Officer Susan Zarlengo said they went to the ZBA in 2005, asking for a variance to build on the lot, and were denied because there are access issues.
The property is small and closely abuts neighboring lots. The Hilliards have placed a small, run-down camper on the lot, a portable toilet and several white plastic lawn chairs. They have hung a clothesline and laundry, taped off the lot and posted numerous no-trespassing signs.
"There's a paper road and a little piece of land there," said one neighbor who didn't want to be identified. "Then he came with the Porta-Potty and then the trailer. It has small, broken windows. He took trees down and put up a big black tarp. He had a burn permit the other night and a small fire going. He sat drinking beer with his friends, surrounded by dead trees."
The woman said town officials were out to look at it last Friday.
"We are all sitting here thinking, ?What is he going to do next?'" said the woman. "It's not a nice thing what they're doing. The Porta-Potty is right by someone's door."
Zarlengo said the items violate town ordinances. She said both the camper and the Porta-Potty are considered structures and he would need a permit to place them on the property.
"He has not applied for any permits," said Zarlengo.
Zarlengo sent a letter Sept 5 to Paula Hilliard, denying a proposal to build a shelter on the lot, because it is not a permitted use for the residentially zoned area. At that time, she also told the Hilliards to remove the portable toilet within 10 days.
"After I told her she couldn't keep the Porta-Potty there, I would have expected she'd know she can't put a trailer on the lot," said Zarlengo. "I have received a tremendous amount of complaints from the abutters."
A second letter was mailed Sept. 15, ordering the removal of the portable toilet and the camper. The couple has been given one week from receipt of the certified letter to clean up the site.
In the letter, Zarlengo warned that the town can seek court enforcement if the Hilliards do not comply. She said the couple could face civil penalties of up to $250 per day for each day the items remain after notice to remove them.
The Hilliards have until next week to respond to the notice in writing. Phone messages left for them were not returned.
According to a representative at the town's assessing office, the couple purchased the property, assessed at $208,400, for $7,000. The previous owner, Jean Goodrich, bought the same piece in 1992 for $6,000. The assessing office spokesperson said that usually means the land is passing through relatives.
How can it be worth $200,000 if you can't build on it?

No kidding, but obviously it's not actually worth that the last people only paid $7,000 for it. I'd love to help these people. What do you suggest?

If this lot you mention has no frontage and is substandard ---meaning nonconforming in dimensional size they are probably screwed. Caveat emptor.
nonconforming to organized crime can mean so many different things .... including good. :)

This land is right near a very popular beach with very little parking.
They COULD operate a parking lot in the summer and make zillions.
Then they could buy land anyplace they want.
Just one solution if this gets so ugly they will have to spend money to fight it.

It's actually a fabulous idea. My cousin bought a small bit of land on the opposite side of the boulevard and tore down the shack that was on it. It can park about 30 cars. She runs a rental lot for the surrounding beach cottages and makes $300 a day in the summer!

I just see all the time how these blueblood ryeites and the people of North Hampton, Hampton (in town), and Hampton Falls . . . they seem to be quite Massholelike. .. not allowing neighbors to do things that are perfectly legal. They get skiddish around the sight of a gun and worse . . . they will cry and whine about being watched. . . but they set their houses up so that they're able to watch what their neighbors are doing.
remove the portapotty. . . dig a latrine. We should ask if we can have a meeting there.
