The US Department of Justice sent a notice today that they've put out a warrant for someone named Katherine Kanningdillon for disorderly conduct. They said they'll arrest this person in 10 days if the $125 fine isn't paid. It's signed by Stephen Monier. They sent a notice a couple of months ago, but we never signed for it, so didn't know what it said.
So it's likely they'll come on the 16th to arrest me.
I think you should request a copy of the charges and the actual specifics.

Wow, a federal "disorderly conduct" charge? Any idea what this may be in reference to?
Also, who is Katherine Kanningdillon?
They sent a long description of the arrest at IRS office for Lauren and I.

you'd best get a plan.
their next move will be to come to your door with a warrart and cart you off.
they did that to me years ago.

I had wondered when this would come back. It had to have been late last summer when the initial arrest occured. The roundabout was still being built.
For those unfamiliar with this event, Kat and Lauren intentionally provoked an arrest at the Keene irs office above the post office. They simply went in there and refused to leave. They were eventually arrested, and released about an hour later. I believe they did this to protest the imprisonment of Dave Ridley, Dadaorwell here. His imprisonment was for contempt of court for refusing to pay a fine given for a silent protest at the Nashua irs office.

do we need to plan a party or something at that afternoon if we think there will be an arrest?
Wow, I'm totally amazed that the Feds are pushing a disorderly conduct charge.

Last time they came for Russell it was in the morning, right?
that was for missing a court date at 9am .... they came straight here and got me around 10:30am
Kat doesn't seem to have a court date ... so I don't know when they will come for her.
It was for the torture sign and Lauren joined her.
Maybe they wanted something easy to arrest me for if I showed up to the FIJA thing on the 18th.

No need to be paranoid. Since he was telling her this at the trial when he saw her, my guess is that if they wanted to "set her up" they just would have arrested her right then.

Three-day barbecue? Balloons and welcome banners lining the driveway? Seventy-six trombones as they arrive? (I wanted to post a video from Porky's, showing the "welcoming committee" at the county line, but my youtube-fu has failed me.)

BTW, I won't eat anything in jail...I'll just have water.
It'd be cool if someone went off into an IRS office while I'm in jail.
Yeah, with a clipboard and gave them a survey:
Should customers to a business be jailed for offering improvements to the service?
Should tax protesters be arrested before they get to the IRS office?
Should tax protesters have all their clothes taken away in jail?
Do you think the overall level of oppression is high enough now?
Would you like more money stolen from your neighbors to pay your salary?
That sounds like fun.

And apparently smiting me.
Hi Kat: some ideas for you.... in re case.... YOU NEED to arrange for a COPY of
(don't see a scan of the notice that you were sent about 10 days to pay 125$...)
basically, your arrest on Federal property(leased or owned) becomes a federal court matter...
speeding in a national park is another example...
they have this somewhat informal procedure to "disposition" these matter with small "plea bargain type conferences" with the representatives of the "prosecutor/dept. of justice folks"... mostly fines...
BUT if that process does not work, you can have a Trial . Judge only if it is a fine. Should be JURY allowed if imprisonment is a possible outcome. NOW the warrants allow "dentention" for the time to get you before a magistrate (that is doing the delegated job-task of an actual life term federal judge) under a contempt type basis. CONTEMPT "detention" has to stop when it becomes "punitive" and further detention is unlikely to
change your "contemptuous" position or holding.
YOU NEED to arrange for a COPY of all papers ON FILE in the COURT CLERKS office in your matter. SEND someone down there to ask for a copy of the records under "PUBLIC RECORDS ACT."
A bad name (kanningdillon) does not invalidate the warrant. the warrant they bring (if they bring one) need not be signed. THE signed ORIGINAL warrant will be returned to the Magistrate/judge "after" execution and arrest.
ARREST will occur at the time and place of choosing of the arresting agency (in your case probably) a deputy federal marshal at some public place. HOWEVER if you are "pulled" over for speeding/stop sign violation and the "warrant check" returns this warrant, you may be booked or "cite and released" at the jail on this warrant.
re-read the above to better understand it...
The jury thing doesn't seem to be allowed for small cases, even if there is jail time.

I don't want to dive off into it right now, but I'm pretty sure that's only for criminal trials. Or possibly the guarantee of juries in civil trials over a certain amount.
Anyhoo... states where certain things are "violations" or "civil infractions" don't have to provide juries.
Any traffic ticket in Texas is (at least) a Class C misdemeanor. Sucks to have a "criminal record" for speeding, but it lets activists demand a jury trial if they get a ticket for 37 in a 35.
Another registered letter came, but I didn't pick it up.
Doesn't really matter if you go to pick up the registered letters or not. If the Feds or Courts are notifying you of something, and you choose to (willfully) ignore the notification, you are still responsible.

Why does the Fed Court waste money on a certified letter if it doesn't matter if the notification is received or not? (rhetorical)
The Fed Court will do what ever is convenient to it's self, with a passing nod to procedure.

Yes, it does matter. There are procedural rules. They have to notify you, not attempt to notify you. If the letter isn't signed for, they'll send a process server.
in the past they sometimes skip that step or go down another path
It is funny when they make a big deal out of handing you a note. Dave Ridley once had a guy shaking while he tried to hand something to him. We have had bills stuffed in our pockets. I had notes placed in front of me that I said I wasn't going to attend or pay attention to ... the cops try not to hear that stuff. :)

The court may think the obligation is valid. Is there an objective way to determine validity? Perhaps. If I send you a bill for a service rendered, and you choose not to retrieve or open the bill, is the bill served? Yes i realize the courts are not really providing a service , I'm just using this as an example to illustrate problems that can occur when the burden of notification is all on one party.

The notification requirement may (note MAY) be satisfied simply by sending the letter registered mail. Not every notice requires a process server, although in this case you may be correct that it would require a server.
But even if the server physically hands the notice over, there's no obligation to open the envelope. If one never actually sees the notice, is it served? Probably yes. Willful blindness isn't a good defense.
Best of luck either way. Maybe you can make a collage of all the government notices you receive. Sort of a Tribute to Bureaucracy. >:D
