According to Porc411 calls that have come in today, a group of topless protesters today demonstrated in Keene. One of them happened to be female (Cassidy) and she was arrested. No news of male protesters being arrested has surfaced.
Activists are currently en route to the police department.

The cops completely danced around what the law says. It says nothing about breasts; it specifies "genitals", which breasts are not. It also doesn't say anything about panic.

The video I took made no effort to be "YouTube-friendly," and clearly depicts what the audience most wants to see.

I previously posted on the Free Keene forum that I felt this kind of activism is a bad idea because it's a law that's actually *supported* by the majority of our fellow Americans, for whatever reason, and therefore a poor choice for civil disobedience.
By coincidence, this morning the radio morning show that I listen to while commuting to work every day had a call-in survey on the following subject: Should kids be allowed to take their shirts off in public? This is a radio program geared towards a young, educated Boston-area listening audience, and the three hosts are all fairly young and extremely liberal (they lurve Obama). Anyway, there was overwhelming consensus: it's "weird" and "uncomfortable" if CHILDREN go out in public without shirts on. The only debate was over exactly where the cut-off point should be: 2 years old, 3 years old, etc. They were very clear on the fact that they were talking about young children, with no possible sexual connotation involved (unless you're a perv, which they were adamant they are against). Every single caller agreed with them.
I'm not saying I agree with this position; I don't. It's just a demonstration of the mindset of the general public amongst whom we live, and a possible indication of the odds of success of a campaign to gain public acceptance for women to go topless in public.

All the response I've heard so far has been positive. The people on the scene were all supportive. One lady even showed up at the police station with some RSAs she'd printed on her home computer. She wanted to talk to the officers about how it was a wrongful arrest because they quoted something incorrectly. Later I was chatting about it at the Community Kitchen on a coffee break and every single person there, including two Mormon missionaries, agreed that she had done nothing wrong and it was ridiculous to arrest her.
In forums discussing this, I've seen two general responses.
One: "She did nothing wrong." Certainly most of us here agree with that, and many more of the general public agree with it, than would care to admit it in public.
Two: "It shouldn't be illegal, but if she broke the law..." Most people with that opinion quickly come around when they see that she didn't break the law (no genitals, no "gross lewdness").

Well, that's great news. Perhaps the public is more ready to embrace a Live and Let Live attitude on this issue than I thought.
I remain a bit shocked at the uptightness of the DJ's on the radio yesterday. Seriously, a 4-year-old little girl can't take her shirt off if it's hot and humid outside?? Actually, I can remember taking my own shirt off when I was either 5 or 6 and living in Maryland, which is a freakin' swamp in the summertime, and some "helpful" adult told me I was too old to do so. Even at that age, I was pissed.
It's funny how much the conversation at the Community Kitchen mirrored some of the conversation on Free Keene. Even before I said it, others were saying "They're for feeding babies!" and "It's the same as a man. They're just shaped differently." and "It's not fair to treat women differently than men." and so on. Common sense stuph.
Oh, but her gun. Now THAT was a different story. The Mormon missionaries agreed with me on that as well though.

The armed teenager who was arrested while topless in downtown Keene did not break the law, according to police prosecutors.
Cassidy Nicosia, 18, of Manchester no longer faces a misdemeanor charge of indecent exposure and lewdness.
Nicosia was arrested Aug. 23 after police received complaint calls about a topless teenager standing near the Main-Marlboro-Winchester streets roundabout with a handgun holstered on her hip.
State law does not require residents to have permits to openly carry guns, and she was not charged with any firearm-related crimes.
Last week, police prosecutors D. Chris McLaughlin and Eliezer Rivera decided to drop the charge of indecent exposure and lewdness against Nicosia. The charge was dropped because walking down the street topless does not qualify as a crime under state law, Keene police Lt. Jay U. Duguay said.
The law states that a person commits indecent exposure and lewdness if he or she fornicates, exposes genitals or performs any other "act of gross lewdness ... likely to cause affront or alarm" in public.
"She wasn't fornicating or exposing genitals — breasts aren't genitals," Duguay said. "No one who complained about it said that it was gross lewdness."
While towns and cities may enact ordinances that prohibit women from going topless in public, Keene has no such ordinance, Duguay said.
"The officer (who arrested Nicosia) did what he thought was right at the time," he said, "but sometimes you take a second look at these things and realize the law is not really worded the way you thought it was."
Two other factors played a role in the police prosecutors' decision to drop the charge against Nicosia, according to Duguay.
They wanted to keep the N.H. Supreme Court from having a chance to weigh in on the law, which could have happened if Nicosia was convicted and appealed, Duguay said. If asked to examine the state law dealing with indecent exposure and lewdness, the court might find that the language in the statute is too broad and then drop the entire statute, he said.
Also, Nicosia went topless to make a statement about equality, which could be viewed as a form of expression or free speech that is protected under the First Amendment, Duguay said.
"I chose to do it because ... one of the most important issues to me is equality," Nicosia said while being videotaped before her arrest. "Men can walk down the street ... and, you know, not get harassed at all but yet somehow this is dirty."
Nicosia is a member of the Free State Project, an effort to convince 20,000 people to move to the Life Free or Die state and participate in various forms of activism and run for local and state office.
Attempts to reach Nicosia before press time were unsuccessful.
Ian "Freeman" Bernard, a talk radio host and outspoken member of the project, said other women were planning to go topless outside Keene District Court during Nicosia's arraignment, which was scheduled for Wednesday. He wasn't sure if the topless demonstration would still occur.
While Nicosia no longer faces a criminal charge, the dismissal prevents her from challenging the law and paving the way for other women to go topless in public without risking arrest, Bernard said.
"By dropping the charge they've really headed off any way to challenge what they've done and set a precedent," he said. "Hopefully, if this happens again, if someone like Cassidy decides she's hot and wants to act like her male counterparts, they can be left alone."

Sadly, PatK, I'm going to take a wild guess and say that not one single person involved did actually apologize. Did the prosecutor talk to or write to Cassidy and actually apologize? How about the arresting officer? Did he tell Cassidy, "I'm sorry?" What about the processing agents? I'm guessing that not one person involved actually apologized -- because they honestly don't believe they did anything wrong.
They quoted Ian in a way that made me misinterpret. It looks like he's suggesting women who think they're attractive should go topless.

The officer didn't want to arrest her. He didn't know of any crime. He called in and someone told him to arrest her. I know this will not come as a shock to anyone, but someone is LYING. The officer on the scene is being scape-goated when it was someone back at the station who ordered the arrest.
