Title: "Announcing the death of the liberty movement" or Topless Arrest!
Post by: K. Darien Freeheart on August 23, 2009, 01:15 PM NHFT
According to Porc411 calls that have come in today, a group of topless protesters today demonstrated in Keene. One of them happened to be female (Cassidy) and she was arrested. No news of male protesters being arrested has surfaced.

Activists are currently en route to the police department.

I was dying laughing at the libertarian geeks having a philosophical discussion with the cop with the topless chick standing there.

The cops completely danced around what the law says. It says nothing about breasts; it specifies "genitals", which breasts are not. It also doesn't say anything about panic.

645:1 Indecent Exposure and Lewdness. –
    I. A person is guilty of a misdemeanor if such person fornicates, exposes his or her genitals, or performs any other act of gross lewdness under circumstances which he or she should know will likely cause affront or alarm.

Did they know this was going on?

Quote2009 August 12. On August 23, the second annual "Go topless" day will take place in several American cities, to promote topfree equality. For the rationale and a list of cities where demonstrations and other activities are planned, go to the site of Go Topless. (Although we know some of the people involved, this is not a TERA event.) It seems that in New York City, Jordan Matter will be present, with his fantastic new photographic book, Uncovered. More about his book will appear here.

The cop's excuse for calling backup was the "guns".  How nice for them to have mirrored sunglasses on during the entire affair.  They certainly weren't in a rush to arrest her.  Think they were enjoying the view?

I can't take this Liberty Equality stuff.  >:D Guess I'll have to quit and go back home --- Oh wait, I am Home!

Guess I'll have to "put up with" the whole beautiful young woman with nice breasts thing until I can find some other place where activists are actually taking a stand.

This young woman has caused me quite an "alarm!" Death of the movement! - "they" say - again.

Someone "ruining it for the rest of us" - AGAIN!
Oh my.

I can't quite tell what she's doing, (which is fine. The video is to document the police encounter, not show off her breasts) but it looks like when she's talking to the cop, she's got her hands folded over her breasts.

I can't say I would blame her, but if the whole point is to protest inequality laws for toplessness, wouldn't she want to not be concealing her breasts with her hands?

Or are they folded below them.

Anyway, just a thought I had.

The video I took made no effort to be "YouTube-friendly," and clearly depicts what the audience most wants to see.
And I can understand her feeling a bit self-conscious being gawked at by a guy who probably yells "Bang! Bang! Bang!" when he comes . . .

Cass was topless. So was I. Cass did have her arms folded in front of her breasts sometimes during our walk and the cops' detainment of her. So did I. She also had her hands on her hips sometimes, used her arms and hands for gesturing, and let her arms rest at her sides at various times. So did I. Cass' breasts were visible. So were mine.

hey politicos. . . are you sick of these evil boobie women showing off their breasticles?  Would you just like them to stop this silly stupid kazoo civil disobedience?  Do you want to squash this now before more men and women decide to go topless?

Hire me. . . I got probably the ugliest manboobs in the world.  The sight of them will frighten all around me into re-dressing (ha) and leaving the scene.  I show up, whip off my shirt, after I'm done jiggling from all that motion the people will get a clear view of freedom, through the bowels of my bosom.

now I just have to prove that my chest isn't an initiation of force against the eyes of others.  I don't want to aggress.

Gold and silver accepted.

Undoubtedly pissing into the wind, but....   ::lloyds::

I previously posted on the Free Keene forum that I felt this kind of activism is a bad idea because it's a law that's actually *supported* by the majority of our fellow Americans, for whatever reason, and therefore a poor choice for civil disobedience.

By coincidence, this morning the radio morning show that I listen to while commuting to work every day had a call-in survey on the following subject: Should kids be allowed to take their shirts off in public?  This is a radio program geared towards a young, educated Boston-area listening audience, and the three hosts are all fairly young and extremely liberal (they lurve Obama).  Anyway, there was overwhelming consensus: it's "weird" and "uncomfortable" if CHILDREN go out in public without shirts on.  The only debate was over exactly where the cut-off point should be: 2 years old, 3 years old, etc.  They were very clear on the fact that they were talking about young children, with no possible sexual connotation involved (unless you're a perv, which they were adamant they are against).  Every single caller agreed with them.

I'm not saying I agree with this position; I don't.  It's just a demonstration of the mindset of the general public amongst whom we live, and a possible indication of the odds of success of a campaign to gain public acceptance for women to go topless in public.

Now, as Russell and Miracle Max would say, Have fun storming the castle!   :horse:

We're approaching a strange twist on Victorianism, which was probably the sexually kinkiest period in history, but pianos had floor-length coverings, lest young men become aroused at the sight of a piano leg.

All the response I've heard so far has been positive. The people on the scene were all supportive. One lady even showed up at the police station with some RSAs she'd printed on her home computer. She wanted to talk to the officers about how it was a wrongful arrest because they quoted something incorrectly. Later I was chatting about it at the Community Kitchen on a coffee break and every single person there, including two Mormon missionaries, agreed that she had done nothing wrong and it was ridiculous to arrest her.

In forums discussing this, I've seen two general responses.

One: "She did nothing wrong." Certainly most of us here agree with that, and many more of the general public agree with it, than would care to admit it in public.

Two: "It shouldn't be illegal, but if she broke the law..." Most people with that opinion quickly come around when they see that she didn't break the law (no genitals, no "gross lewdness").

Well, that's great news.  Perhaps the public is more ready to embrace a Live and Let Live attitude on this issue than I thought.

I remain a bit shocked at the uptightness of the DJ's on the radio yesterday.  Seriously, a 4-year-old little girl can't take her shirt off if it's hot and humid outside??  Actually, I can remember taking my own shirt off when I was either 5 or 6 and living in Maryland, which is a freakin' swamp in the summertime, and some "helpful" adult told me I was too old to do so.  Even at that age, I was pissed.

It's funny how much the conversation at the Community Kitchen mirrored some of the conversation on Free Keene. Even before I said it, others were saying "They're for feeding babies!" and "It's the same as a man. They're just shaped differently." and "It's not fair to treat women differently than men." and so on. Common sense stuph.

Oh, but her gun. Now THAT was a different story. The Mormon missionaries agreed with me on that as well though.

It worked on me.  I've been a FSP lurker for a long time.  I just could never, ever picture myself living in the North East.

1) Cold
2) The birthplace of Liberty, where almost every Original State has now become the very Tyrants they once took up arms to oppose...  Disgusts me.

But find me a place where there are women who do something other than hide under a rock and collaborate with Big Brother...  I might just tolerate some snow for that.

I wanna shake that woman's hand.

Nice!

Police radio during Cassidy's detainment on Main Street has officers saying, "Without a victim, I don't have a crime. I'm going to have to let them go." Apparently, no one felt victimized enough to be the official complainant to the police.

Has someone gotten a copy of the radio traffic?

Charges dropped.

I'd like to suggest the liberty ladies reschedule their protest to a warmer time of day.  It'll be pretty brisk at 8:30a.

Alright Cassidy, you may have more Ridley hits, but it is I who killed the liberty movement;

"Kostric does indeed represent a trend within the libertarian movement, one that shows every indication of getting out of hand... And the dangers of that are many, and ominous:

1) It sets up the libertarian movement for government surveillance and infiltration. Under the PATRIOT Act, the government has the "right" to spy on anyone suspected of planning illegal acts, and any act of civil disobedience can be construed as "terrorism."

2) It marginalizes the libertarian movement, and gives the professional "extremist"-hunters as well as the Obama-ite left a reason to tie a seemingly violent "fringe" with individuals and groups working to preserve what remains of our economic and civil liberties.

3) It is bound to end in a violent incident: Indeed, there have already been confrontations between the "tea-baggers" and union thugs at those town-hall meetings. It is only a matter of time before a gun goes off, either by accident or by intention.

4) By allowing the "mainstream" media to tie Kostric and his supporters to Ron Paul, the Ron Paul campaign apparatus and the Congressman himself are endangering the passage of his important "Audit the Fed" bill, which has amassed so much support and—at this point—seems likely to pass in some form."

Sorry for the threadjacking, we now return you to your regularly scheduled toplessness.

My comment on Justin Raimondo article.
(Let's see if it gets accepted)

QuoteWe could all just vote for another 1 percent candidate. Or write articles and maybe if we are respectable enough the powers that be will let us be free. If any of these tactics had a chance of succeeding they would be illegal.

Sorry to see Justin is another of the "old guard" that is an obstacle. Good luck with your "Reclaiming the American Right" effort. The "law and order"/nationalist/constitutionalist crowd is about as morally bankrupt and dangerous as the socialists are.

Others might want to check out for themselves. NHFREE.com, FreeKeene.com etc.

The Free State Project is just the "bus" that gets people interested in moving to New Hampshire. The groups and individuals that engage in these efforts are going their own course.

Jason Sorens is an Assistant Professor of Political Science at the University at Buffalo, not Yale. (By the way)

Charge dropped against teenager
Free Stater went topless in city

The armed teenager who was arrested while topless in downtown Keene did not break the law, according to police prosecutors.

Cassidy Nicosia, 18, of Manchester no longer faces a misdemeanor charge of indecent exposure and lewdness.

Nicosia was arrested Aug. 23 after police received complaint calls about a topless teenager standing near the Main-Marlboro-Winchester streets roundabout with a handgun holstered on her hip.

State law does not require residents to have permits to openly carry guns, and she was not charged with any firearm-related crimes.

Last week, police prosecutors D. Chris McLaughlin and Eliezer Rivera decided to drop the charge of indecent exposure and lewdness against Nicosia. The charge was dropped because walking down the street topless does not qualify as a crime under state law, Keene police Lt. Jay U. Duguay said.

The law states that a person commits indecent exposure and lewdness if he or she fornicates, exposes genitals or performs any other "act of gross lewdness ... likely to cause affront or alarm" in public.

"She wasn't fornicating or exposing genitals — breasts aren't genitals," Duguay said. "No one who complained about it said that it was gross lewdness."

While towns and cities may enact ordinances that prohibit women from going topless in public, Keene has no such ordinance, Duguay said.

"The officer (who arrested Nicosia) did what he thought was right at the time," he said, "but sometimes you take a second look at these things and realize the law is not really worded the way you thought it was."

Two other factors played a role in the police prosecutors' decision to drop the charge against Nicosia, according to Duguay.

They wanted to keep the N.H. Supreme Court from having a chance to weigh in on the law, which could have happened if Nicosia was convicted and appealed, Duguay said. If asked to examine the state law dealing with indecent exposure and lewdness, the court might find that the language in the statute is too broad and then drop the entire statute, he said.

Also, Nicosia went topless to make a statement about equality, which could be viewed as a form of expression or free speech that is protected under the First Amendment, Duguay said.

"I chose to do it because ... one of the most important issues to me is equality," Nicosia said while being videotaped before her arrest. "Men can walk down the street ... and, you know, not get harassed at all but yet somehow this is dirty."

Nicosia is a member of the Free State Project, an effort to convince 20,000 people to move to the Life Free or Die state and participate in various forms of activism and run for local and state office.

Attempts to reach Nicosia before press time were unsuccessful.

Ian "Freeman" Bernard, a talk radio host and outspoken member of the project, said other women were planning to go topless outside Keene District Court during Nicosia's arraignment, which was scheduled for Wednesday. He wasn't sure if the topless demonstration would still occur.

While Nicosia no longer faces a criminal charge, the dismissal prevents her from challenging the law and paving the way for other women to go topless in public without risking arrest, Bernard said.

"By dropping the charge they've really headed off any way to challenge what they've done and set a precedent," he said. "Hopefully, if this happens again, if someone like Cassidy decides she's hot and wants to act like her male counterparts, they can be left alone."

Right, Pat.

When people don't understand the law and police enslave them, but when police don't understand the law, then people are enslaved.

And will the over-active under-educated policeman be punished?

Sadly, PatK, I'm going to take a wild guess and say that not one single person involved did actually apologize. Did the prosecutor talk to or write to Cassidy and actually apologize? How about the arresting officer? Did he tell Cassidy, "I'm sorry?" What about the processing agents? I'm guessing that not one person involved actually apologized -- because they honestly don't believe they did anything wrong.

They quoted Ian in a way that made me misinterpret. It looks like he's suggesting women who think they're attractive should go topless.

Interesting admission.

Gotta say again, fantastic job!

Would anyone who strenuously objected to this like to weigh in?

The officer didn't want to arrest her. He didn't know of any crime. He called in and someone told him to arrest her. I know this will not come as a shock to anyone, but someone is LYING. The officer on the scene is being scape-goated when it was someone back at the station who ordered the arrest.
