My mom just called and said Russell got arrested.  :-( She said they got him at is work. I don't know anymore details at the moment, but i'll keep it posted.

The West Leb police claim to have not made any arrests today.

I called the State Police and they claim they have not arrested Russell.

I called the Grafton County Sherrif's office and she claimed to not have a deputy in the office to research it but she took my name and number and said she'd get back to me. I don't feel she was being evasive.

Russell is okay. He has been processed and as of this moment his arraignment is to be determined.

Kurt just called me. He spoke with Officer LaPorte? who said that Russell will be arraigned at 8 am at Superior Court. He was arrested on the child support issue.

I don't know whether he was sentenced for anything, but when I called the court clerk today she said he was being held "because he didn't pay his child support."  She was very abrupt with me and not very forthcoming.  I didn't have a lot of time to engage her in conversation to find out more details.

That was this afternoon around 3:15 and I asked her whether there was a hearing set for Monday morning.  She said that they hadn't yet scheduled a hearing in his case yet but that they were in the process of doing so.

I didn't get a chance to call back until after 4 and they were closed.

Does anyone know whether they set his case for hearing in the last 45 minutes of their work day today?

I figure that they'll be in no rush to get him in front of a judge.

The jail told me just now that Russell is not in population and has no visitor hours yet. I overheard him saying to another jail-cop that Russell was in "112" (I'm assuming cage #112), so I asked him: if Russell isn't in population, what is 112? He said it was the room they were using to hold Russell but he's no longer there, but he's not in population yet - he's in the process of getting there (or something like that).

Ah, thanks. I knew about the child support stuff, but didn't know he had any criminal charges here related to it that would result in a jail sentence. (That is, I thought they had some sort of warrant out of California, and if he be arrested, he'd either be held until the Calif. bureaucrats came to take him, or like what happened last time, they would just hold him indefinitely until he agreed to pay.)

Has anyone figured out who arrested Russell?  If it was the staties, then it appears the staties are on a free-stater roundup, with Jim being arrested tonight and Lauren wanted.   >:(

No the 7 days was  for driving without a license.  The stuff in Superior Ct is about child support.  But they're both the same thing really.

It would be much appreciated if people called the jail and asked if Russell is being given his mail.  I've been told they're withholding his mail.  Cheshire County Jail (603) 399-7794

BTW, J'raxis, thanks for the jail list on NHCLOG.  It really came in handy when I was trying to find Russell.

Called the jail to ask about Russell's arraignment. He went and asked a supervisor and told me he couldn't give out that information. I was told he is recieving his mail... don't know wether to believe him or not.

Anyone know so I can go spend some time in court, a place I enjoy hanging out in so much?

Went over and saw the Vice Prez, Joan of Winchester and the Wordsmith as they were leaving.

Apparently Russell's arraignment was yesterday... SOP to lie to us.

The petty tyrants continue the bad blood... I suppose they reap what they sow.

I am wondering about the Human Right Violations at Van Wickler's facility... What are the temperature limits, air circulation requirements... apparently in has reached 120 degrees in the bubble.

Yes.  They want $2000/month.  I make $800/month.  I can't keep him out of jail on that.  They apparently aren't going to let him work a regular job.  There's no way out of this.

In the meantime, if people want to help, I think it would be good to call the court and ask them to let Russell work.  It's rediculous to demand all this money from him, while silmultaneously making it impossible for him to work.

Ask Richard Van Wickler... or at least ask him about the conditions in his prison. What are the standards for temperature and ventilation?

I know his answer... it's the best they can do before moving into the new wonderful facility. Which he is real excited to operate... the only obstacle to his plan... Russell Kanning... tar baby... Career dude, should remember that.

The $50/day thing is for fines, not judgments; we don't (officially) have debtors prisons in the US.  You can pay the State's fines by serving jail time, but if there's a judgment saying that he owes his X a certain amount per month, he can't "pay" that by serving time.

No one's posted the actual details of the charges, but I expect he's being held for contempt of court - that is, willfully refusing to abide by the order the court gave him.

However, proving a contempt charge requires that they establish that he was given a lawful order (a judge can't order you to go murder someone, and hold you in contempt for refusing), that he failed to obey the order, and that he was capable of obeying it.  It's that third part that would likely apply in this case, if his income does not allow for him to pay that amount.

Again, that's guessing at what they're doing, without knowing the details, but I expect that's the case; simply owing money is not a jailable offense, unless it is supposedly "owed" to the State.

There's no $50/day for this.  It's debtor's prison.

I couldn't find in his file what the actual charges were with the court harridens yelling at me.  The arrest warrant was for not showing up in court.  There wasn't anything in his file about what happened Monday, but they told me he was being held until he pays $10,000, and that money isn't considered bail.  This is for child support.

When I looked at it Tuesday, there wasn't anything about what happened on Monday, that I could find.  That court has NEVER let me attend one of his appearances.  They've always changed the date/time at the last minute, I assume to make sure I can't be there.

It sounds like a contempt of court (http://www.gencourt.state.nh.us/rsa/html/xii/167/167-3.htm) charge.  If so, inability to pay is a defense.

The holding cell... not properly ventilated. Bubble, because it's like being a firefly trapped in a jar. The place they make as unpleasant as possible to torture people into giving away their rights.

Remembering that many folks in their custody are considered innocent, because they are awaiting trial. I believe if they have to hold you awaiting trial, it should be of the caliber of the Motel Six... you haven't been found guilty of anything yet... there should be no punishment aspect, bad enough to lose your liberty.

I just called Cheshire Co. Jail to find out if Russell has any visiting hours.   They told me they moved all the prisoners to the new jail today.  The new phone number is 903-1600.  When I called the new jail, they didn't have any record of him being there. 

Maybe he escaped.

I just spoke to a woman cop at the new Cheshire jail and she said that Russell is in "segregation" and hence has visiting hours only on Mondays; we can go any time we want, without an appointment, and have a maximum of one hour visit, according to her. Actually, Perhaps Russell can have a maximum of one hour of visitations all day (all week). If so, we should coordinate who visits him so that people - like Kat - don't drive all the way from Grafton only to be told that Russell has already had his visitation quota.

Also, FYI: normal visiting hours (for those in population, not segregation) are 8:00a to 10:00a 7 days a week.

I was able to look at the file today.  A hearing appears to have been scheduled for 4-20-10 at 1:30 but that date had a line drawn through it.  It was in the portion of the file that is handwritten (on the left side when open).  Looking at the file alone, I was unable to determine that anything had even happened with the case this week. Perhaps there is an order being written somewhere that describes what happened in court.  I don't know, but I doubt the order will mention anything about the fact that the hearing was apparently rescheduled.

The big question I had was about the nature of the proceeding.  It does appear to be a "civil" matter of contempt instead of a criminal case.  They are both nasty but at least with a criminal case there is a fixed term of imprisonment.

It is all very sad.

The question then would be whether Russell wants anyone to file papers demanding that they show their cause for holding him.

The bright light of day can often help out in these shady dealings.

But I could certainly understand Russell preferring not to go down that road.

Guess someone needs to consult with him and find out what flavor of assistance he wants.

Around a dozen people arrested at the jail protest for trespassing.  There are the ones I've been told were arrested:  Ian, Dale, Richard, Rich Paul, Sean, Lauren, Jim, Menno.  I believe most have been released, except Lauren, who had the warrant out for her.  Bastards picked her up.  I think they knocked Richard down.

Rescue from what? He, and me and about 5 others, parked at the motel across the street from the jail. The caretaker or owner there gave us permission to park there for an hour. He said, I think, that after 2 hours he would have them towed (or something). I hope Jim's van wasn't towed!

Happy to go. Not so happy to get arrested, but when you don't do whatever ridiculous thing they say, that's what happens. Russell was very happy to see us.
50 + people were brave enough to do it.
If someone ends up in the clutches of the state they know they won't be forgotten.
A dozen court cases for them to have to deal with.
The issue of the War on Dads is going to draw people to NH.
The issue of the jail being called "private property" is now highlighted.
Everyone had a good time.
First time many of the participants had done something like this...
etc.

Apparently it's like an hour at any time of the day.  There was discussion about coordinating and scheduling a time so we could all visit during that limited time but then it didn't happen.  No one took initiative to lead.   :-\  I suspect if someone had just posted a time, a fair number of folks would have made holes in their schedule and shown up.  I feel awful about this.  Just the day before, we're rallying for Russell and then we didn't even show up for his visitation.  I'm going to get a letter in the mail right away to him and apologize.

I don't know, no one has talked to him.  He had some money on him when he was arrested, but maybe they took that and gave it to Mindy.  Maybe they don't let him order stamps when he's in 'seg'.

Stephanie answered the phone and confirmed for me that he does have some $ in his canteen(?) account and that he should be able to receive and send mail at this point.  She said that there may have been some delays with mail, both in and out, due to the transfer of everyone to the new facility.

Unless something changed recently, I'm pretty sure this part of your article is inaccurate:  "In order to get back into the lives of his children Russell went against his anarchist beliefs and got the necessary government paperwork to get a real job and went to work in order to pay the child support."  Russell has made no secret of the fact that he speaks to his kids on the phone, and has gone back to California to visit them.

I based that line on something Kat said in the video on page 4 or 5 on this thread.  Perhaps a better way to word it would be "In order to be more involved with the lives of his children Russell went against his anarchist beliefs and got the necessary government paperwork to get a real job and went to work in order to pay the child support." Yes?

I went to see Russell yesterday.  He looked terrible.  He didn't even *smile* and he looked like they hadn't let him shower in there.

He said they should let him out of 'seg' anytime.  If they do, he can have visits every day between 8 and 10 am for 1/2 hour.

Saturday is his birthday.  I bet he'd appreciate some notes or cards or such.

I just called the jail.  Russell's out of 'seg'.  So if anyone wanted to go by and see him this morning, he's got a half hour between 8 and 10 am.

The receptionist (yes, they have a receptionist) said the marlboro post office sent all the mis-addressed mail to the jail.  The jail rejected it because - everyone together now- it was mis addressed.

Russell was smiling today.  We got to have a video conference with him.  He has not gotten mail at the new address, but is out of confinement now and had taken a shower and could play basketball.  He said he's looking forward to his basketball team playing on the wide-screeen tv in a few days.  I trust if they let Russell go before that he wouldn't be too disappointed.

The mail, your mail, that was addressed to 825 Marlboro Rd in Marlboro DID arrive at the jail.
The post office realized the mistake and forwarded the mail to the jail.
The jail refused the mail because it did not say Keene on it and misdirected an entire sack of mail back to senders. 
The jail does not except forwarded mail from their former Westmoreland address either.

For anyone who is passing by the jail;

Russell can be visited any time from 8 am to 10 pm.
All you need is government ID.
They will ask for a telephone number, but if you don't have one... they don't seem to care.

Visitation between 8am and 10pm every day is by half hour increments.  However, if no one is waiting, apparently they can keep extending your time.  There appears to be no limit on cyber visitation.  Feel free to stop by anytime between those hours and you will likely get to visit him.

I can see it both ways. Advantages to both the prisoner and family include very extended visting hours (you'd never see 8a-10p visitation seven days a week in a traditional visiting room that has to be staffed by officers). And, neither visitors nor prisoners have to go through the search process required for contact visits.

On the downside... no contact.

I asked the receptionist about visitation over the Internet and that is something they're considering and possibly implementing at some point but it's not available yet.  She mentioned Skype and it sounded ambiguous as to how readily available it would be.  Sounded like they might be mainly using it for arraignments or something.

This is my understanding - if it's wrong, I hope Russell or Kat will correct me.

Russell told Kat during a visit that he wanted to pay the $3K to his ex-wife so he could get out of jail and be earning an income again, but since he didn't have the money he asked for loans that he would repay within 1 year. We took up a collection and raised over $3K in under 2 hours. Russell was freed a few hours later and is home now.

i will probably not be in jail again for a while

Kat and I knew that i was risking arrest by getting a  government id and getting a normal job with  a ssn. That is how they found me and jailed me. I might be able  to go back to work at Kmart next week or so. I also have a few other jobs I can probably set up soon. If anyone wants me to do construction or landscaping work for them, let me know. I also do windows. :) I have been driving around the last couple of months, which also risks my arrest, since the government will not give me permission to drive.

Kat and I live fairly cheaply. We can live on about $1200/month. I would like to give my ex-wife $400/month. Right now the state of nh wants me to pay $1500/month. I was not making that much before they threw me in jail. Hopefully the government will ask for less in the future .... I will make more money ... and they will stop throwing me in jail.

as other people go to this jail the visits will be more frequent and easier

yea .... we didn't get many showers or clothing changes in the bubble or the 1st week in segregation
i was washing my clothes in the sink in the new jail
but they did have fresh air in those little rooms in the new jail

my cell was 15 feet  long so it took me 176 round trips for a mile of walking
when i got out for an hour in the cell block a round trip was 150 yards

You mentioned you could use some work and also do some construction type stuff?  do you by chance do tile?  i have two smallish bathrooms I have been looking to get taken care of.

Id like to help out with the Hoyt Farm residents, if it is possible.  It wouldn't be much (probably $50) but it would make me feel better being that I am 900 miles away.  So if somebody at Hoyt has paypal(probably the easiest way to do it?) and then can handle it from there on that end.
