Department doesn't fault woman for delayed stop

The Greene County Sheriff's Department says a young woman acted reasonably in driving farther to a lighted area on South Campbell Avenue after a deputy tried to pull her over for speeding early Thursday morning.

But Sheriff's Capt. Randy Gibson also defended the three deputies who responded, saying they handled the incident appropriately.

"We don't fault her for what she did," Gibson said Friday. "We all have wives and daughters, and understand the heightened concerns people have when they travel at night."

There have been several recent incidents in which women were attacked in Missouri after being pulled over by someone pretending to be a law enforcement officer.

The department issued Vanessa Kimery, 22, a speeding ticket and cited her for failing to yield to an emergency vehicle following the 2:40 a.m. incident.

The failure to yield charge was dropped Friday morning after the department concluded Kimery wasn't trying to elude the deputies.

Kimery said she now understands why the deputies responded the way they did, but felt their action "was a little excessive."

Kimery said she couldn't tell what kind of vehicle was trying to stop her, so she put her car's emergency flashers on and drove about 3/4 of a mile to a well-lighted convenience store parking lot before stopping.

Three sheriff's deputies followed her into the lot, the stop captured on one of the deputies' dashboard cameras.

They ordered her out of the car and held her in handcuffs for about five minutes while the deputies determined whether she was intoxicated.

"I knew I was speeding, but when I stopped at the gas station I thought it would just be an ordinary traffic ticket," she said.

"But they had a gun pulled and were yelling 'put your hands up, get out of the car, put your purse down'," she recalled.

"I was crying. I was thinking, 'Why am I being treated this way?'"

Gibson confirmed one deputy had taken his weapon out in a "defensive mode" as the deputies analyzed the situation.

Kimery's mother, Sandra Grizzard, said she was initially angry after hearing about the stop. But after seeing the video and talking with the sheriff, she now has a different opinion.

"Before I saw the tape, I envisioned them being a lot more aggressive than they were," Grizzard said.

"From the officers' point of view, not knowing what kind of situation they were getting involved in, they're trained to be extra cautious and to protect themselves."

The stop occurred during early morning hours, which tend to be the most dangerous for law enforcement officers, Gibson said.

"We know better than anyone else the bad guys that are out there at night," he said. "When they make a stop, we don't want our officers making dangerous assumptions about what that person is or is not."

He said Kimery was handcuffed until deputies could determine whether she was intoxicated or might try to escape and injure herself or others.

Satisfied she wasn't a threat, the deputies took the handcuffs off and talked to her about the stop.

"They were nice," Kimery acknowledged. "They were just trying to calm me down. But they did tell me if I'd driven any further they'd have spiked my tires -- they would have considered it a pursuit."

Gibson said deputies weigh the "totality of the circumstances" in deciding how to respond to a motorist who fails to immediately pull over.

In remote areas, he said motorists are advised to reduce their speed, activate their vehicle's emergency flashers and continue driving to a well-lit public place before stopping.

If there's any doubt about whether the person making the stop is legitimately a law enforcement officer, Gibson said a motorist should dial 911.

"If the dispatcher has no record of a traffic stop, in short order there would be additional officers there," he said.

The sheriff's department has five unmarked vehicles that occasionally are used to make traffic stops.

If pulled over by an unmarked patrol car, Gibson advised a motorist to lock the vehicle doors, roll the driver's-side window down about an inch and ask for identification.

"If your suspicions aren't immediately resolved, ask the officer to follow you to the nearest well-lit area," Gibson said.

"But if an officer perceives there's the possibility of alcohol being involved while you're driving, things escalate," he said.

"It is a process where there's going to be risks interpreting perception for both parties."

Springfield Police Lt. Scott Leven said motorists in the city have few reasons not to pull over quickly when a police officer attempts to make a traffic stop.

"We're pretty fortunate," he said.

"We've got good lighting, thanks to City Utilities. But once you leave the city limits, it's a whole different situation."
