Airport Access Road Eminent Domain Facts?

it is the reason given for allowing an individual the privilege of enclosing the commons - because it enhances the common good.

The land that is being taken has NOTHING to do with the access road.

The taking is for wetland mitigation. In other words the state is going to destroy a wetland creating the new road. To get away with "destroying one they have to ppreotect another.

Some of the property being taken is 5 miles from the road site!!!

all surface bodies of water over 20 acres and all groundwater is owned in common in NH

wetlands are connected directly to the aquifer so the state as the public trustee has an interest in protecting a common asset.
OK, that sounds reasonable. Now, my land is being flooded by the drainage pipes that have been put in over the years, that funnel the water in and is blocked by a man made dam. Now, in the back of my property what looks, like a small creek that passes through my property. My land is a man-made wetland, blocked/flooded by the state. It is not a natural water supplier of the groundwater. Once the state takes it over, I have no control of who is in my back yard and they want to raise the water level. Now when the water level is higher it floods the junk yard that is next door to me and all the containements from the junk yard go right back in to this holding area, which is flooded.
