Court documents say man who allegedly gave teen heroin prior to fatal OD was DEA

ROCHESTER — The man who allegedly gave 17-year-old Eve Tarmey heroin prior to her overdose death was working as a confidential informant for the Drug Enforcement Administration, according to court records.

Mark Ross, 41, of Rochester, was paid by the agency on three occasions between March 7, 2014, and Oct. 21, 2015, when the DEA found out about his involvement in Tarmey's death, according to records filed in federal district court.

Ross made a total of $2,000, according to the records.

The fact that Ross was working as a confidential informant was revealed in court documents because an illiterate man originally from Mexico claims entrapment in his own drug case. Lorenzo Ramirez, 58, of Rochester, is charged with selling fingers of heroin to an undercover member of the DEA Task Force.

Ross introduced Ramirez to Officer Steve Hamel on Feb. 11 during a recorded meeting inside Hamel's vehicle. Hamel was parked at the Staples in Rochester. Ross told Ramirez he was starting a new job, and Ramirez would have to be Hamel's supplier.

Hamel told Ramirez he was looking for "two full," meaning two grams of heroin. Ramirez allegedly removed a plastic bag from his pocket and provided Hamel with the drugs.

On Feb. 18, Hamel contacted Ramirez for a second purchase. This time he asked for 10 grams of heroin. Hamel and Ramirez met again in the Staples parking lot two days later and $600 was allegedly exchanged for nine grams of heroin.

Hamel asked about getting two "fingers," which is 20 grams of heroin. He told Ramirez he has clients in Lawrence, Mass., and they arranged to meet up the following week.

On March 4, after Ramirez allegedly took over $1,200 in exchange for the fingers, he was arrested by Hamel and another undercover officer.

Jonathan Saxe, a federal defender for Ramirez, claims entrapment because Ross was allegedly selling the heroin to his client and pocketing all of the DEA money.

"He was doing what his friend, Mark, had manipulated him into doing," Saxe said in court documents. "He did not know where to buy heroin, how much to pay for it, or how much to sell it for."

Saxe pushed for the DEA to release the last name of Ross and payment records. Chief Judge Joseph Laplante granted his requests.

Saxe expressed frustration after finding out Ross was involved in Tarmey's death.

"In the process of distributing drugs, he has allegedly killed a 17-year-old girl," Saxe said.

Ramirez will go on trial next year.

Ross has been charged with distributing a controlled drug with death resulting, conspiracy to possess drugs, two counts of witness tampering and falsifying physical evidence for his role in Tarmey's death. Police claim Ross put a piece of heroin on a motel room table and watched the girl crush and take the drug, which was laced with fentanyl.

She was found dead in bed the next morning at 3:30 a.m.

So  the obvious question is.....will NH Attorney General seek murder charges against the "supplier".

He was just burning up NH newspapers running his mouth about seeking second degree murder charges if the supplier was known in the epidemic of heroin type drugs etc.   

Will the snake eat his own tail?  Or in this case spank his brethren?  Me thinks not.
