The statute does not mention any requirement that the activity be commercial in nature.  It is a poorly-written, badly-worded, overly-broad statute (and stupid, to boot).

True. This frequently happens when laws are written to the standard of "Well, everyone knows what we meant..."  Let a few years pass, and then those who don't know "what we meant", will be enforcing it to the standard of "what they said".

Given that John David has the fastest growing fingernails in the world, and that he's a typical grubby little boy, we wind up trimming and cleaning his nails a couple of times a week. I'm pretty sure we did it at least once while we visited NH.

Should we throw ourselves on the mercy of the Cosmetology board?

I sense a great opportunity for Outlaw Manicurist II... the exceptions don't allow for parent/child, so perhaps one of our NH families would like to shampoo or manicure a young'un in public without compensation nor license, since that's also apparently illegal.

Next to where my sister works there is a nail salon run by a Vietnamese guy.  Cars come and go and come and go, all day!  He has others.  Whenever I see these places I think of this article by Virginia Postrel, my favorite libertarian.

A very good article, indeed. The writing is impressive: top-quality with very few errors. Postrel needs to move to New Hampshire.

     That's an idea that might have some merit.  I have heard of protests and demonstrations in the form of 'civil obediance'.  Participants turn themselves in en masse, simultaneously overwhelming the authorities and drawing media attention to the ridiculous regulation.  Penalties are usually token.  I believe the critical element is that participants break the laws individually and privately, but turn themselves in as a group.

Those breastfeeding activists do this kind of thing a lot with big sit-ins.  I believe they call themselves lactivists.
