Okay; that makes sense, then.  What would happen if someone with one of these things tried to go through and didn't have any money on them?  Would you be okay with them taking a snapshot of the license plate and sending a bill?

This would be the same as someone without an EZ-Pass going through the toll today. Send the bill.

Sure. Tracking someone who violated the law is a whole different, and more acceptable, issue than tracking people who are following the law (i.e., all the other EZ-Pass customers).
