Fighting Foreclosure

As some of you know, I have spent the last year helping my landlord fight against his illegal foreclosure here in Michigan.

There was an enormous amount of fraud taking place in the mortgage industry that could never have been known by homeowners when they bought their home or refinanced their existing loans. There was even more fraud taking place by the investment bankers through the process of mortgage securitization. It is through this pattern of fraud and non-disclosure of material facts that give homeowners numerous defensive claims to fight their foreclosure in court.

I have helped a few people here in Michigan build their case against their lender (or the foreclosing entity) on a word-of-mouth basis. I am now beginning to share my research with as many homeowners as I can.

While under construction, I started a blog at makeyourstand.wordpress.com outlining various strategies that can be used in court. It is important to note that these strategies are primarily intended for loans that were part of a larger, securitized transaction.

When I visited Manchester this past spring I was amazed by the number of foreclosure auctions listed in the newspaper for such a small state, and I know it's killing your property values. It doesn't have to be this way.

They need to take some actions before the auction happens, so timing is important. I know of two attorneys, one in Manchester and one in Exeter, that are familiar with these same lines of defense that can assist them as well.
