What: Hearing RE: Blogger access to Ayotte media events
Who: Christopher King of KingCast.net , various Republican officials whose actions he's questioning.  The Clerk there is John Safford
I'm planning to be there and you can best reach me via RidleyReport at live.... period com
Where:  Hillsborough County Superior Court South 30 Spring Street Nashua, NH 03060 (603) 669-7410
Why:  To support the rights of "little media" or just observe and report yourself.
When: Wed. 27 Oct. 2010.  8:30 a.m. activists gather .... hearing scheduled to begin half an hour later.  Hearing projected to be over around 10:30 a.m.

Christopher King, the operator of Nashua's lively KingCast blog, is suing Sam Dodson's alleged tormentor Kelly Ayotte.  Details are at

http://www.nashuatelegraph.com/news/887281-196/blogger-sues-ayotte-others-over-access.html

There will be a hearing on Wed the 27th.  He wants to stop Ayotte from inviting some media to her events while having police threaten others like him with arrest.

He's invited us liberty folk to attent and observe the hearing Wednesday, and he has commissioned me to film what goes on in my usual way.  Obviously if I'm working for a specific person that can affect the coverage and so I will be providing disclaimers indicating that I'm on his clock.

Having said that, this is a wonderful opportunity to link up with one of the local folks who's been battling for press freedom a long time here.

I had previously been feeling guilty that I hadn't provided more coverage to King's difficulties with the Powers....was just waiting for the elements to come together so that I could provide some
coverage different from everyone else's.  Now I don't have to wait and you don't either!

Here's some other background from Christopher, who BTW is not to be confused with the blogger of the same name from Vermont:

The lawsuit that prompted a 17 November 2010 hearing is hosted on wepapers here:

KingCast

Hello and Good Day to all,

As you could imagine, I'm quite flat out right now.   Some of you may remember when I was hanging out here before, dealing with some of the same cast of State thugs characters.

This is a very important case because it is GOP policy to destroy anyone from new media that they cannot control, anyone who is not a yessir no sir kind of journalist.

Here's the kicker:

I put up a new movie today showing that they had already allowed me to cover the event then changed up on me only after the high GOP brass found out I was there:

Two minutes of First Amendment hell for Kelly Ayotte, Jeff Grappone and Fascist Pig Ryan Williams.

http://www.nashuatelegraph.com/news/889252-196/court-to-decide-bloggers-fate-before-election.html

http://christopher-king.blogspot.com/2010/10/nh-gops-ryan-williams-is-fascist-pig-he.html

23 October 2010

NH GOP's Ryan Williams is a fascist pig, he and Kelly Ayotte ejected Plaintiff KingCast after he had already been approved by Dennis Hogan and Di Lothrop.
***********
Remember, I'm not "just" a blogger, I have worked for a daily as a reporter and edited a weekly, and award-winning journalists have stated that I am a good journalist, and that journalism "needs more Chris Kings."

Anyway it's clear that I was professional and it's clear that I was in the Joe Arpaio event to be a reporter, I professionally interview Joe Arpaio as did the major media, and I asked him if he was aware of the previous Immigration initiative in Monadnock Valley in 2005 when Kelly Ayotte had ruled it Unconstitutional to criminalize undocumented workers (and believe me, most of them ARE workers) by charging them with trespass.

Nashua Republican City Committee Chair Dennis Hogan vouched for me to Di Lothrop, who had already asked me if I had signed in, I told her yes, and everything was hunky-dory. Then Ryan Williams saw me and he and/or Kelly Ayotte changed the picture, the video discussion with Dennis Hogan and Di Lothrop, which I saved until yesterday, doesn't lie and it's all right there. I wasn't kicked out for being a disturbance or because they didn't consider me a reporter, but because of my VIEWPOINT, and that is antithetical to the First Amendment. And Dennis Hogan's quote that I left voluntarily is the most ridiculous thing in World, you can hear the police threatening to arrest me and see the picture of them ushering me out:

Unbelievable.

Russell Kanning

it is their event
you might have to just make videos of how the gop has no interest in letting outsiders report on their rotten actions

KingCast

No no no my friend, there is an entirely different level of legal analysis go to through, you've got to read the Sistrunk/State Action post:
http://www.wepapers.com/Papers/123182/KingCast_v._Ayott,_GOP_Sistrunk_Memo:_Private_Property,_State_Action

http://kellyayottesenate.blogspot.com/2010/10/kingcast-sistrunk-memorandum-says-weve.html

Sunday, October 24, 2010

KingCast Sistrunk Memorandum says "We've got State Action here, folks.... and viewpoint based discrimination is unlawful even in a nonpublic forum."

KingCast_v._Ayott,_GOP_Sistrunk_Memo:_Private_Property,_State_Action
Reversed and remanded.

"Off-duty police officer was acting as a state actor when he commanded demonstrator to leave art festival, for purposes of action brought against city alleging First Amendment free speech violation stemming from demonstrator's exclusion from art festival held pursuant to a non-exclusive block party permit, regardless of whether the officer was on or off duty, where he presented himself as a police officer, he was dressed in his official police uniform and his badge was displayed, he identified himself as an officer and, while he did not actually arrest demonstrator, he nevertheless threatened arrest." U.S.C.A. Const.Amend. 1.

******
If, however, the forum is found to be nonpublic, "[t]he Government's decision to restrict access ... need only be reasonable; it need not be the most reasonable or the only reasonable limitation." Cornelius, 105 S.Ct. at 3453 (emphasis in original). But "[t]he existence of reasonable grounds for limiting access to a nonpublic forum ... will not save a regulation that is in reality a facade for viewpoint-based discrimination." Id. at 3454. Citing Cornelius v. NAACP Legal Defense and Educational Fund, Inc., 473 U.S. 788, 105 S.Ct. 3439 U.S.Dist. (Col.,1985)
KingCast flat out told all of the State Actors and Di Lothrop and anyone standing in the immediate vicinity:

"I am being singled out to leave, and this is unlawful,
viewpoint-based discrimination."
This is of course obvious because Dennis Hogan and Di Lothrop had already admitted KingCast into the event, with the express understanding that I was there as a REPORTER. But then Ryan and Kelly went to work on me because they couldn't control my editorial content. You haters watch the friggin' movie and shaddup already.

thinkliberty

Typical, a politician hating on the people they are suppose to represent.

Give em hell KingCast!

Dave Ridley

Not sure how this ended up listed on the weekend calendar section  but in any case the event's timing is now up in the air.
King reports this event has been removed to Federal Court, date not yet known.
That in itself is raising eyebrows; King's suspicion is that the goal is to make this happen somewhere cameras aren't allowed.

"Bloggers' Rights" hearing quashed? Civil Rights, New Hampshire

Russell Kanning

I don't think Bloggers have rights under this system.
It might even be in the US Constitution. :)

Good one, true.

That's why I don't go by "blogger" I go by "journalist."

Meanwhile: YouTube took down my N****rmania video so I am informing them that I am opposing hate speech not validating it. I find this somewhat crazy.

Meanwhile, 5:20p:

As of close of business, the Ayotte/GOP counsel Mary Tenn has not notified Nashua PD counsel Brian Cullen of the Ayotte, GOP intentions regarding Removal to Federal Court.

I find this conduct to be less than honorable from an attorney whom the Union Leader ranked as a top 40 under 40 who has "fiercely intelligent with the common sense to go with it."

There's at least two or three things in there that can't go together in a single sentence!
