Repeal of same-sex marriage advances

CONCORD — The state's law allowing gay marriage would be repealed under a bill that a House committee endorsed Tuesday.

The House Judiciary Committee voted 11-6 to pass an amended version of HB 437. The bill repeals gay marriage, but continues the validity of same-sex marriages already in place. It states that once the bill takes effect, the state will recognize only marriage between a man and a woman.

It sets up a form of civil union that can confer the rights and benefits of marriage to those who join in them.


Interesting twist:

The bill is written to allow anyone, including brothers and sisters, to enter into civil unions. Critics said that seems to violate state incest laws, but Bates said they are wrong. The bill does not negate other existing laws, he said, adding, "there is no reason for us to speculate on the sexual nature of that relationship."

The important point, he said, is that the bill restores marriage in its traditional form and provides an option to those who do not want to marry or cannot under the law.

People will call a relationship what they want, whatever works best for conveying the nature of that relationship. A civil union implies a very utilitarian arrangement, like agreeing that you're a family of some sort in terms of being supportive of each other, sharing bills, living together, etc. That's all it entails automatically. "Marriage" is just a word, but words are communication and honest communication is important. This is another area where gubment needs to butt out altogether, but as long as they insist on butting in, they need to treat all the people they're stealing from under the pretense of serving them, the same, even if it just comes down to words. And if the Feds ever come around to recognizing marriages with regard to all the different ways they intrude into our lives, like kicking someone you love out of the country, then simply not calling it a marriage can actually lead to harm.

All that said, I'm still have no faith in political action so the discussion remains mostly academic for me.
