the latest on my trial as of  5 pm  11/14/08   jury pick  9am 11/17 and trial on  tuesday morn. if all goes as planned by the          state vs Joseph Roux   the state seems to care less about juggling me all around the court system I can not wait to get this behind me

my lawyer says there will be no just disappearing we picked jury today im feeling pretty good about it they learned about compeating harms laws and im pretty sure tommorow we will demonstrate how i did the right thing by miving the gun to my safe out of the hands of psycho killer ill let you all know how i did tommorrow cross your fingers

Wow, if they let you mount a competing harms defense, you've got a good shot (pardon the pun).

For those not familiar with the doctrine of competing harms, it's the legal theory that creates a valid defense whenever obeying the law would result in more harm than breaking it.

"Yes, I was speeding, but I was trying to rush this critically ill person to the hospital."
"Yes, I kicked down my neighbor's door and trespassed in his house, but it was on fire and I knew he was inside."

Or in Joe's case, "Yes, I was a felon in possession of a firearm, but only because I took it away to prevent a death."

    GUILTY Im wondering if those fucking jurors were in the same room i was in cause the states only 2 witnesses were aboth state police and both agreed the gun was safer in my hands than drunk psycho and the fact that il callled 911  just goes to show you never know that jury of my peers all blue haired old ladys
