My right wins, i very tangibly own the property, they don't very tangibly regulate commerce.  They attempt to regulate it and sometimes there goons interfear more then others.  But because everyone else that works for me has the choice to stay at my place, or work for someone else i think commerce is already regulated by the people who are participating in it... if it wasn't NH wouldn't have had any nonsmoking workplaces before the ban.  and this also is clearly not about the employees because there are still businesses that you can smoke in, cigar shops, smoke shops, private clubs ext...  If it was really about regulating commerce and protecting the feeble employee that cant make any decisions those businesses wouldn't be exempt.  The law would read, "this here nanny state of NH demands that workers not be exploited anymore and our comrades in any business venture where time and labor are being traded for income (especially taxable income) smoking shall be baned, because we want our comrades alive to mill our wheat when were getting good health care."

I . . . what?  Yeah, I know, but that's a non sequitur.  You can eliminate that legal fiction and just deal with the rights of the people who own the corporation.

Technically a repeal can be submitted in '09, after the general election.
Realistically, this issue will be determined 100% by whether the Republicans gain back the the House and/or Senate.
If the Dems keep control of both... save your energy, the ban will remain in place.
I agree. But it needs to be kept at the forefront of consciousness.
