The Decision is 31 pages long. Kelly took some hits. I'm not done reading the Decision. That will take me a day or two to digest and let it sink in. Sure I lost some things I think I could have won on but that's okay. What I did win, is huge. I will pick at this Decision like a fine piece of warm pecan pie with Hagen Dazs French Vanilla Ice Cream a la mode.

Regarding the video of the 5/11 dash cam:


[KingCast] may copy the original video under supervision of custodial police authority.

And the AG's office got dinged for failing to provide protocol regarding homicide investigations:


"The Court has reviewed the cases and affidavits on which the Attorney General's office relied in originally denying the Petitioner access to its protocols for investigation of a homicide and finds that such withholding was not justified."

As KingCast requested, the State was ordered to provide some Affidavits as to the validity and depth of their purported searches for information, which is good:

As to the Troy Watts Complaint against Bruce McKay (here it is, and to KingCast one of the 3 most important issues) the Court wrote:

"In this case, the Petitioner has demonstrated several positive indications of materials that were not located in the search, including Attorney Watts' statement as to the existence of his complaint against Officer McKay, and a document that may be the requested police report, inadvertently disclosed (KingCast is in possession of what appears to be a police report that Franconia claimed not to have!)

The Franconia Defendants must therefore undertake another search, since this search lacks indicia of reasonableness...."

This is the first I've heard of this and I'm not really sure what's going on. I briefly checked out the blog and am still hazy on who's doing what to whom... Maybe sometime I'll have more time to check this out in-depth. But, I will await your analysis of the case...

As a media identity "KingCast.net" (sister site "Justiceforkids.net") I sued the AG and Town of Franconia for RSA 910-A/Right-to-Know/FOIA violations relative to their so-called "investigations" of the Franconia Shooting Tragedy of 5/11 '07.

As a result Grafton Superior Judge Vaughn held on 6 March 2008:

1. Franconia has to provide McKays ENTIRE UNABRIDGED police file to the Court for review. I swear to Gosh that not all of that is private, as noted here.

2. Franconia has to provide Affidavits from all involved about their searches for missing information on Use-of-Force and Police Reports because they lack "any indicia of credibility," per Grafton Superior Judge Vaughn.

3. Kelly violated the law by not giving KingCast the homicide protocol when requested. That's important because information in that protocol explains who is responsible for the integrity -- or lack thereof -- of the Dash Cam Video from Bruce McKay's Tahoe which brings us to the Bonus Round and Door Number 3, potential disbarment for Defendant Ayotte if things don't pan out well:

4. The biggest issue is that NH AG Kelly Ayotte has to provide access to KingCast to review the actual video from Bruce McKay's cruiser. I'll link other stuff but for not pay attention to this, which I have sent to all NH State Reps in the Judicial and Criminal Justice/Public Safety Committee:

Second, think about how the video starts: Here is a version I've seen with Bruce's call to dispatch on it. Weird, huh. It's possible that someone dubbed that in using the dispatch call, as the version I have from the AG fun pack is nearly silent all the way, albeit with what I believe to be muffled sounds that may be brought up by my crew -- if and when we get a chance to hear it. Be that as it may, in one of the WMUR versions you can hear the wind rush as McKay accelerates at 19:10:00 and muffled voices at 19:13:10 and voices again at 19:14:20 and again at 19:15:30 when McKay is face-to-face with 3 time felon Gregory Floyd and still more at 19:15:40 as McKay bashes Liko's car and Liko raises both hands in shock and defense.

Third, there is no rhyme or reason to why the sound starts when it does, as McKay is already walking from his cruiser and almost at Liko's car when we hear the siren sound cut in. If he cut the mic on from the Tahoe we would have heard more audio because it took him several seconds to exit the vehicle and appear before Liko's car on the far side of the Tahoe. There is of course the possibility the McKay turned on his mic from his hip the instant before he walks on screen -- he's infamous for stunts like that -- but that doesn't square up with the muffled sounds heard throughout other portions of the video.

PS: Gregory Floyd, who shot (murdered IMHO) Liko Kenney is a 3 time felon and Kelly knew all about that and the fact that he lied about being a Marine in Vietnam but she withheld that information from the American Public. There is a Motion for Reconsideration before Judge Vaughn as to whether that is a violation of the law as well because he was not clear that she had the documents from Floyd's Military records that substantiate my assertions that he spent all of his time at Camp Lejune where he was in fact AWOL twice. Well she admitted she had them:

I knew I was taking a major risk when I got into this case nearly a year ago after Liko's friends wrote me, as at the time I was just blogging about it and saying it didn't look right. But with my background in media, law and as a former AAG the more I started digging into it the more it stank to high hell.

And getting worse by the minute.

OMG I totally forgot that the State and WMUR misrepresented/edited the first 2003 video between Bruce McKay and Liko Kenney by only showing the World public half of it. Watch the rest of it and read what Liko told McKay about the Fourth Amendment in the comments section to this post.

First of all Angela McKay's Restraining Order is not complete and contains only the two page dismissal. It is Littleton Family Division 1998-0009 so if my posse would be so kind as to round up the rest of it I'd be much obliged.

Second is Policy D: Pursuit Tactics:

What part of that did McKay not understand? I hate this guy.

Next there is a 6 Oct. 2000 complaint by Franconia Fire Department George Whitcomb that appears to have been followed up with no response. Mr. Whitcomb wrote that McKay exhibited unprofessional and imbalanced behaviour, i.e. training an "extremely bright" spotlight on him that was frustrating his attempts to secure the scene. Twice asked to turn it down McKay said,
Quote"And I quote: If you ever touch my cruiser again you will be in more trouble than you can handle." Then he went south through the accident scene at a high rate of speed that was "totally uncalled for." Mr. Whitcomb was "curious why he was even at the scene as I don't recall hearing anyone involved ever calling for him."

Nice guy, that Bruce.

Franconia Fire Department Chief Harvey Flanders (a former Police Officer himself) wrote Chief Montminy on 30 October 2000 and dressed McKay down:

2. The Chief needs to be aware of the misrepresentation of facts in Officer McKay's log and report. Please see Officer McKay's log vs. Grafton County Dispatch radio log which I have supplied to you and the report referencing incident #00-558-OF."

I have requested a meeting numerous times with you, Officer McKay, George Whitcomb and myself to discuss this event."

Now can anyone doubt the Troy Watts email to KingCast saying he filed an unanswered ethics charge against Bruce McKay?

Then there is the Affidavit I filed in KingCast v. Ayotte et al (Grafton 07-E-268) on behalf of a Mother whom I promised I would not directly reveal her identity but who said that Bruce flaked out on her and was allegedly suspended after he misperceived some biker activity at Hillwinds Motor Inn.

To make a long story shorter, she wasn't lying even if McKay was not suspended. Trooper Todd D. Landry wrote on State letterhead:
Quote"If one is in pursuit, how do 40+ motorcycles get strategically placed on the outside perimeter of a parking lot and no one gets arrested or summonsed when it is clear that the suspects are the ones that are present?"

More on this later. I need to take a break to get my head together after reading this and knowing that there is stuff worse than this in the documents they weren't compelled to give me. All of this done with the tacit approval of NH AG Kelly Ayotte of course.

Just from the two Kenney incidents, it's obvious McKay had an anger problem. Lots of cops use faux "anger" as an intimidation tactic, but this guy really was a loose cannon.

Here's the kicker:

That vehicular pursuit policy is of paramount importance because it defines the standard of care owed to Liko Kenney regardless of the no-contact order that had been in place and how one interprets that. It was a red herring and this is the Big Kahuna Tuna.

Ten-to-One Kelly knew about that Policy and counseled with her former sidekick (look at the picture) Dan Mullen to keep it on the Low.

But because the policy arguably defines negligence and how police must govern, it was clearly a public document.

So the failure to produce it, which trumpeting the video without mentioning the breach in the standard of care, and while working with Franconia to publish the 2003 video on the Friday before the Monday release of the 2007 video, and getting up with WMUR to show only half of it -- constitutes a orchestrated pattern and plan of Conspiracy to deprive the public of its Right-to-Know.

None of this was an oversight.

She should be disbarred for that, just like Mike Nifong.

Just my opinion, as a Free Citizen I do have that right to say so, based on facts and reasonable inferences.
