Just caught a cop

The mom just came home. She says she bought a Playstation at a local pawn shop and this detective shows up at her house while she was at work and basically stole the Playstation saying it was stolen. The pawn shop submitted the serial number to the police and got the go ahead to sell it. Now this cop shows up  without a warrant or any papers, scares the pistola out of the kids and teens and steals the playstation. The oldest boy called her at work scared to death saying "mom I don't know what to do". The reason he keeps coming back is to have one of the kids "sign something". He always shows up while she is at work. Hmmmmmm....

She is going to get a lawyer tomorrow. Detective Peterson is going to get a fine tribute in the Rock River Times next week.

The same detective showed up at my neighbor's house again this morning. I wasn't home. Apparently he brought another detective with him.  ;)  ;D

They pleaded with my neighbor to sign the release form. She refused saying "you haven't taken anything from me". She says her son will not sign the form either. Good for both of them. She also said that you could visibly see the disappointment on their faces when she refused.

I've got one day to get my story researched, written and submitted so it can make next week's paper. Gave my editor the details already. Kat any response to your e-mail?

She's as clueless as I am. Over a PLAYSTATION for cryin' out loud!! I will be calling my lawyer tomorrow to ask for guidance. I want lots of eyes on this guy.

Because my neighbor has a 15 year relationship with the pawn shop owner, he has taken pity on her situation and given her another Playstation to replace her "missing" one. Apparently the original was stolen. HOWEVER after being notified 5 months ago of the Playstation's serial number (as required by pseudo law) the Rockford, IL police department had not seen fit to respond. The pawn shop sold the console.

This should be interesting on a number of different levels.

Crossed my mind for a split second. What a huge mistake that would have been. I don't know the law well enough to know if reaching in a window to unlock a door is actually breaking. More like trespass? Anyway it would have been a feather slap on the wrist for him and worse for me I'm sure. We'll put it in the press and see which direction the wind takes it.

I had a conversation with a lawyer Friday to address my liability in writing this story. I want to make sure I don't make any mistakes no matter how small. I will call again tomorrow to ask about breaking vs. trespass.

Agreed.

I talked to the lawyer again. He said the cop's actions could be construed as trespass but that the state''s attorney and the judge have discretion to accept the allegation as trespass or a lesser charge and can even refuse to hear the case. Business as usual in the old boys club we laughingly call "our" government.
