Excellent. The more the merrier. The courtroom we were in last time had limited seating, however, so get there early so you don't have to stand in the back or get squished into the benches.

Updates posted to the Tea Party thread, as usual.

The trial was continued to 2008-12-18T13:15 because the judge recommended Bill, one of Ivy's witnesses, speak to his lawyer before testifying. I think there's also a hearing at some point on 2008-12-30 (plan for 08:15—that's when court opens), for Ivy's right-to-travel memorandum of law.

Video (probably multiple videos, as I got about 90 minutes of footage) will be forthcoming as soon as I have time to edit and post.

I don't get it, you say the actual trial for Ivy is January 09, 2009?

Reminder:

Tomorrow is the remainder of Ivy's trial for Disorderly, False Report, and Suspension of Registration.  This starts at 1:15pm, so if everyone who is coming wants to meet around 1:00pm, that's when she and I should be getting there.

There's one in Manchester ongoing right now, and one in Merrimack, on 2009-01-09. SMF doesn't seem to allow enough space for me to describe them fully enough in the calendar links, so that's why they look identical.

Ivy's motion to dismiss the disorderly conduct charge was granted by the judge.

I got another hour and a half of video. I'll process out the good parts, especially the argument, counter-argument, and judge's ruling on the disorderly conduct charge. It'll probably be another 5–6 videos in all.

The first post and calendar are updated with the trial continuation's date, 2009-01-05. Not sure on the time yet.

This must be turning into such a headache for the poor State's prosecutor. After her forty-minute motion today, he was completely flummoxed for 2–3 minutes when trying to present his rebuttal. The day ended with Ivy filing fourteen motions with the Clerk of the Court in relation to the officers' misconduct in the 2008-10-10 traffic stop. (I'll let Ivy provide all the details.)

I wonder how many of the fines they collect from all the plea bargains have been eaten up by going after a freestater. >:D

Ivy is welcome to reference my Opening Brief to the 9th Circuit Court of Appeals regarding an illegal joint task force roadblock I ran afoul of in 2002. The brief contains a section dedicated to the Right To Travel along with pertinent case cites associated with the right. While the factual basis of my civil lawsuit differs substantially from her situation, the underlying Right To Travel argument is the same.

The Memo of Law is due to the court by or on Dec 23rd.  The State then has a week to reply.  The Court will then either a) issue a written decision and schedule a sentencing hearing or b) schedule a hearing on the Memo itself and then proceed to sentencing.

She said to say thank you very much!  This might be more relevant than you think.  She also has a Right to Travel case in Merrimack, where she was stopped while traveling through the tollbooth.  The Trooper was just standing on the jersey barrier between the tollbooths and flagging people over.  The stuff about illegal checkpoints might be very VERY relevant to this case.

i wish i lived closer to him, could you imagine 50 people doing the same thing day after day for a month :P

its looks like he lives in the middle of nowhere.  but thats why i suggested he teach a class.  other hispanic looking drivers can start doing the same and shut those stupid roadblocks down.  and I'm sure the gov't people will do somethig stupid, and then they can sue them.
