Case is over and the judge has yet to issue a ruling.

I think Ivy's been busy preparing for the Merrimack trial so she hasn't been online or posted updates here or on NH Tea Party.

I received the court decision in the mail it seems on Friday (I just picked it up today).

On the False Report to Law Enforcement from October 9th:  NOT GUILTY 
On the Suspension of Registration from October 9th: Guilty
On the Failure to Inspect from November 2007: Guilty
On the Driving on Suspended License from November 2007: Guilty
On the Driving on Suspended License from February 2008: Guilty

I have a sentencing hearing scheduled for February 11, 2009.

So, from this, all those fuckers that say "Ivy Walker" is not my real name can GO FUCK THEMSELVES!!!!!!!!!  The court said so.

Bill spoke with Evan earlier today.  Evan claims he filed for and has arranged with the prosecutor for a continuance of Bill's trial.

We called the court to confirm the continuance, and they say they have not received any filing for continuation yet, but call back on Friday just to confirm.  We might still need to show up Monday if no continuance is on file with the court, but we will likely ask for the same continuance if Evan doesn't show up, and also does not file for one himself.

We do not know yet when Bill's trial will be continued to (if such continuance actually gets granted), but we will let you know as soon as we do.

Bill and I feel it would be good for folks to go and support Cynthia in Derry on the 9th, rather than come to Manchester to just have his case be continued.

Interesting.  I had planned on going to Bill's but if it may be moved and if Bill and Ivy feel that my time would be better spent at Cynthia's case in Dover (not Derry), I'll gladly support Cynthia.  This also means I get to sleep a little longer and don't have to pay for parking

When I went over to file the video paperwork, at around 15:00, they told me it was continued, and gave me a date of 2009-03-30.

The clerks are truly incompetent. One of the clerks asked me why I was filing the video motion before the day of the trial. I had to explain to her that their own court rules say the paperwork should be filed as "early as practicable" and last time filing on the day of the trial gave the prosecutor an excuse to object.

A few minutes later, after she noticed from the paperwork that the trial was continued, she asked me again if I wanted to file it "this early." Idiots.

On Failure to inspect: $50 fine plus penalty assessment (for $60 total) - suspended for one year
On 1st Driving after Suspension: $250 fine plus penalty assessment (for $300 total) - suspended for one year
On 2nd Operating after Suspension: $500 fine plus penalty assessment (not sure this total) - suspended for one year

On Suspension of Registration: $240 fine - imposed
    6 months in house of corrections - suspended for two years
This last sentence is stayed until after appeal.

Just a reminder.  Bill's trial is tomorrow morning.  Doors to the courtroom open at 8:15.  This is one of those mornings where you go and sit and wait til your name is called, so eat a big breakfast. 

Evan has filed a pre-trial motion to dismiss, which has to be heard prior to the start of trial.  There is a possibility that, after the hearing on this motion, the court will reschedule for more trial time on another date, so be prepared for that to happen.

And, in case anyone is wondering or interested, we still haven't come close to reaching our legal defense fund goal.  We're about $2,700 short and not sure where that'll come from, so if you can help out, the ChipIn link is at the top of the forum in the News section.
