Homeland Security: Employers can no longer use expired documents in hiring

Beginning in February, employers in the United States will not be allowed to use expired documents to verify workers' employment eligibility.

The interim rule, published on Wednesday in the Federal Register by the Homeland Security Department, aims to streamline the employment eligibility verification process and crack down on fraud. As of Feb. 2, 2009, expired U.S. passports or state-issued driver's licenses and other outdated identification cards will no longer qualify as valid documentation for Form I-9. Social Security cards will not be affected by the change because they do not expire.

"Expired documents are prone to fraudulent use in the Form I-9 process by aliens seeking unauthorized employment," the Federal Register notice stated.

Employers must fill out Form I-9 for all new hires to verify their identity and authorization to work in the United States. The form, mandated by the 1986 Immigration and Reform Control Act, is a key component of DHS' controversial Electronic Employment Verification System. Employers still can use the paper version, but there also is I-9 software that integrates identification information into E-Verify.

New hires can present various forms of identification to prove their work eligibility. The list of approved documents is divided into three categories: List A, which includes documents that verify identity and employment authorization; List B, which confirms identity only; and List C, which certifies employment authorization only. U.S. passports are included on List A, while driver's licenses fall into category B. Workers must either provide one document from List A, or one document each from lists B and C.

The interim rule also eliminates several types of identification included on List A: temporary resident cards and older versions of the employment authorization card/document (Forms I-688, I-688A and I-688B). DHS no longer issues those forms of ID.

While the new regulation takes effect on Feb. 2, the department is accepting comments and could modify the final rule.

See, this is why I use subcontractors, not employees.

None of this nonsense.  No collecting taxes.  And since they are in business for themselves, they tend to be much better at what they do...

The I-9 IS for subs.  I've never been asked to provide ID for one but I haven't filled one out in a few years.

The more they crack down trying to control people, the more they encourage the black and gray markets to expand.

This isn't new. ATF has had this requirement for years: any ID presented when purchasing from a dealer has to be current (and only a DL or state-issued ID will do; passports don't prove your address or state of residency).

Those who have tried to visit Ed, Elaine, and the others have probably run into this as well. Somehow an ID stops being "you" the day after it expires.  ::)

IF the Federal government did it's main job, defend the borders against intruders, we would not have these issues.

If I had my way, I'd put the U.S. Army on the freaking border with orders to shoot anyone sneaking across.

And I'd have the Air Force returning illegals found here back to their country of origin in the back of large jets. Parachutes optional, no landing U.S. flagged military aircraft on foreign soil.

Agreed.

I've watched as they built the fences, the gates, made check points, now they are locking the gates.

The air is much fresher outside the fence. Agitate the people that are going to be realizing they are trapped.

If I want to subcontract "John Smith" (an individual), they will insist on an I-9.  If I want to subcontract "John Smith's Handy Services" (a business - even a sole proprietorship), an I-9 is not applicable, last I checked...

Wow! That sounds disturbingly aggressive and violent. The only reason they're "illegals" is because of the creation of a crime that has no victim, i.e. conducting consensual business transactions like working for wages. So you support the creation and enforcement of victimless crimes. Not only that, but you support a death penalty for said victimless crimes. Why don't you go down to the border and start shooting innocent people yourself instead of comfortably delegating such bloody tasks to others. Put your own life on the line to defend these twisted values.
