RSA 630:5 Procedure in Capital Murder.

XIV. The commissioner of corrections or his designee shall determine the substance or substances to be used and the procedures to be used in any execution, provided, however, that if for any reason the commissioner finds it to be impractical to carry out the punishment of death by administration of the required lethal substance or substances, the sentence of death may be carried out by hanging under the provisions of law for the death penalty by hanging in effect on December 31, 1986.

Interesting, that's the first time I've actually seen the legal basis for the hanging rumor. This site (kinda) dismisses it as an option.

I remember when the Addison murder occurred, I was working in the CJ Department office at NHTI. My boss and I were talking about how it could be the first capital punishment case in NH for quite some time. He told me the only legal option was lethal injection, and I remember skimming a bunch of laws which regarded the manner of execution.

PAT MCOTTER showed hanging is part of New Hampshire's death penalty.

GIGGAN believes hanging is against the 8th amendment.

Please remove state hangings from New Hampshire laws! If you can, you can remove it from America!

You prolly should post that at NHLA's forum rather than here if you want it to have any legs.

I never said that. I said that I'm pretty sure the supreme court ruled that way. I think it's plenty Constitutional, but the Constitution doesn't set my standard of morality.
