We thought the same thing; especially since he lied in front of the same judge that will be trying Mike.

What Kat said! After, when Mike was asking her about the recording for his trial, I went back and asked for my property to be returned, the Dogfish Head 90 Minute IPA beer bottle evidence. She gave it to me! Later, Kat and I went to the Amhurst police station and I asked for the second bottle back, but was told that it was being held as evidence in another trial, which would be Mike's.  ;D

You should try to remember to ask for (demand?) your bottle back after their trial for me is complete. :)

Uh-oh, here I go again . . .:

I was out driving and got stopped by cops
Just as I'd church-keyed off two bottle tops.
He shined in his Maglite and sternly shouted, "Hey!
It looks like you're dri-i-inking
Dogfish Head IPA . . ."

Maybe I'll finish it later (I'm currently on deadline), though it would help if I had a better idea what actually happened.

Also, Ian, don't worry about recording in Keene and Milford, Gov. Lynch is trying hard to close those courthouses down.  Let's hope that happens.  The less courthouses the better.
don't hold your breath .... what will they do with all those cases in Keene?

From what I have read when the judge issues "no ruling" it means they postpone the ruling until a later date. Usually to review evidence....

IANAL and it could mean something different.

I think it was "no finding," although I said "no ruling," too. I just got a thorough explanation from Ivy on FB, and have asked her to post it here, or allow me to post it.

Essentially, depending on the prejudiced or non-prejudiced preface, I could or could not be brought to trial again at a later date. Given that the judge returned my evidence, and said I was free to go without saying anything else, I'm assuming I'm done. Especially since the cop brought up that I asked at the scene for my bottles to be returned because I homebrew, and then she asked the cop the temperature of the bottle when I handed it to him (he said he didn't remember).

Also, and this is very interesting, I'm not sure why the cop didn't just stick to the basics of my issue, as the prosecutor had told me at the arraignment that my case was a foregone conclusion; an easy win for the state, as they had the evidence, and I had admitted that I was drinking, and that I was specifically drinking from that bottle. Yet, he went off on a tangent, got himself all embroiled in lies, and then lost the case. Weird.

They're not done with Mike Barskey, that's for sure. Although, I have very strong and hopeful feelings about this, very hopeful indeed.  :D

Did mike get the audio from the trial? I would love to hear it in on a youtube video or something like that.

Isn't there some 91a provision that allows for retrieval of audio and video from the gang?
