Hey, if anyone else has any links to articles about the cops and courts pursuing a "revenue-based" mission rather than a "justice-based" mission, would you post them here? I'll print them out and put them into my court paper work - I'm going to tell them to follow the line of justice in my case and that the other course is not allowed here in our free country.

Probably won't help Jack this time around, but may be an idea for future political activism... the "revenue enhancement" situation south of the border once upon a time was so bad the state legislature actually put some limits on this stuff, so long ago I can't remember it not being there.

Dunno NH law so well, but Massachusetts has a state law that no more than 25% of a town or city budget can come from traffic tickets. Not sure if parking tickets are included in that limit, though IMO they ought to be for pretty much the same reasons. Maybe a similar (or even smaller?) limit could be proposed for future legislation in NH. Of course we would have to be sure of closing loopholes like "administrative fees" that aren't "fines" that should count toward the limit.... not allowing an "unexpected surplus" to accumulate without a corresponding reduction in next year's budget and/or a moratorium on further tickets until the surplus is used up.... and the same limit for state budgets too!

In my opinion you should fight. Forgetting the moral reasons for a moment, you have a 50-50 chance the cop won't even show up. If they do the costs of paying overtime to the cop may surpass the amount of the fine. This will start to piss off taxpayers once more of them start fighting their tickets.

Also, don't underestimate the value of having your fellow Free-Staters show up in court to support you. With a well planned defense comes a great youtube video that encourages others to make a stand.

Can somebody loan you a copy of "Adventures in Legal Land"? You may find fighting your ticket can be fun.

Isn't he responding to an outstanding court fine?
My understanding of his original post was he missed the hearing on the original ticket.

Agree with Bigmike on this.  Even if you lose and still pay the fine, they will have spent time having the trial for the original issue, and will have slightly less money than if you just paid the fine without fighting it.  As he said, there is a good chance the cop will not show anyway.

I was arraigned yesterday in Merrimack District Court on Driving after suspension - 2nd offense. Told them I absolutely did not knowingly operate after suspension. Clifford Kinghorn, the judge, entered a not guilty plea. He explained that because the 2nd offense was a misdemeanor with up to a 1 year in jail penalty, a conviction requires the state to prove I KNOWINGLY drove after suspension. I told him the DMV had mailed the notice to the wrong address and he said show all my paperwork to the prosecutor to see if the prosecutor would drop the case. That's my next step.
