This story is Real am I am going through this Hell right now!

Any help getting my story out their and heard and possibly end this injustice would be much appreciated!

Dear; Sir/Ma'am

   I feel my U.S. Constitional Rights  are being violated.

   I am a single Dad  who has had Full Physical custody of his two daughters 11 & 13 for the Past 6 years now (My ex wife just started to see the kids every weekend this past year and a half)

I own a two family Home in Berlin N.H and 1 unit is being rented ($500mo includes heat as rents are cheaper their) I currently lost my home of 10 years in Dartmouth, MA and the Bank Foreclosed and took it this past Feb 2009.

I was going to move to N.H. into the 2nd unit of the home I own and told my ex wife this and she was in total agreement last year and this year.

Last minute without telling me I was served with a court order not to leave the State of Massachusetts with the kids July 2008.

I was self employed as a computer consultant and closed my Business due that it was non existent do to the Economy and I was working at Lowe's Part Time to get extra money..

My Home in N.H. is not worth much to sell and homes up there are selling even slower then down here.(Furthermore the $500mo rent I receive pays for the house bills, Heat, taxes,etc.)

Long story short the Judge (Judge Nisi) in Mass is setting this to go to trial and the pretrial was until January  23rd 2008.

** Had the pretrial and during which I was losing my home, Even as I explained this to the Judge he still set it to go to trial in May 12th 2009 to see if he will allow me and my daughters to move into my home in N.H. Meanwhile we are living in an apartment in New Bedford, MA and I am being forced to be on welfare and other state aid.

I am getting numerous Job offers in N.H. as company's are hiring their and I will be able to support both myself and my daughters by moving their. I also was guaranteed a full time Job in N.H. as long as I can start the end of June 2009.

The Judge denied me moving to N.H. with my Daughters even though both I and my Lawyer stated I would bring the kids down to see my ex wife. (Who doesn't work and lives with her boyfriend).

My Ex wife has been seeing a Psychiatrist since last year which she was talking to me like old friends last year then her psychiatrist told her to leave her Boyfriend since he was controlling and emotionally abusive to her, This year she is still with him and seeing a different psychiatrist and on different Meds.

Any Help to let Me move to N.H. with my Daughters (Again I had offered to bring the kids to see her every other weekend and offer her more visitation during the Summer, School Vacations and Holidays.)

My Ex wife is not emotionally stable enough to have full custody of our Daughters and I can provide Dr. Letters and School Letters concerning both my daughters Stating My ExWife hasn't showed concern in their Education or Health in over  6 years.

My ex wife is on SSI Disability for mental illness.

Almost Homeless and on Welfare in Massachusetts with two Daughters when I have a house and a Job to move to in N.H. which I can't.

I am being forced to remain in Massachusetts with my daughters (Which is against the U.S. Constitution) and I am being forced to waste Massachusetts Tax Payers Money by remaining here.

I have already requested the assistance of the Massachusetts Officials, But they refuse to help me. I have hired an attorney with what little money I had to represent me at my trial this May12th. However if I'm still denied to move I won't be able to afford an attorney to appeal.

I'm very sorry to hear your story, Rich. I wish I could offer some help, but I don't know what I could possibly do.

I'm amazed that you were ordered to not leave MA. When mothers have custody, they're free to move anywhere in the world over the father's objections; he won't be able to see the kids, but he sure has to keep on paying. Then again, I'm not so surprised, given the history of judicial bias against fathers (even those with full custody).

(Edit to add: I made a blanket statement about mothers being free to move anywhere, which isn't always true. I know of exceptions, such as limits being placed on how far they can move, but such cases are rare. For the most part, custodial mothers can do what they want, and non-custodial fathers have to accept it and adapt.)

Even though I'm the Father and have had Full Physical custody for 6 years now I would be in contempt and Mass would have NH extradite me back and be arrested for contempt at which point my ex wife whom is on SSI Disability for Mental illness would be able to get the kids at that point.

Had my Trial this past May 12th. Everything seemed to go fine, my Attorney caught my ex wife in numerous lies that were exposed and explained it would be both in the Best interest of my Daughters and I to move to N.H. since I would have no Mortgage or rent payment and I actually have a full time Job being held for me until the end of June (were as I am unemployed in Mass).

The trial was all day and at the end the Judge told us that he would mail his decision to us (Which as of today June 15th 2009 we are still awaiting his answer).

This is extremly nerve racking as a parent as it would be nice to know were to register my daughters in school for next year. and 2. I would have a full time Job oppsed to being forced to be on welfare in Mass!

Hopefully everything goes in your favor since we all know judges decide in people's best interests and all. If ya need a hand moving on up, holla.

Thanks, but 98% of our stuff is already at my Home their. We are literly living out of totes at the moment.
Since I thought I'd be living their last July 08'.
Instead I was forced to stay in Mass and rent an appartment in Mass at $750 a month (which I can't afford) when I own a Home in N.H. (Just a plain crazy situation).

Just got the Court Papers and Judgement today stating that the Judge is allowing both myself and my children to relocate to N.H.
I guess its true that good things come to those who wait.

Finally I can start working full time again and make some money. Very Siked!

I guess once the Judge reviewed all of the evidence and facts, he made his decision which from what I was told the courts are so backlogged thats why it took so long.
