As expected, new charges were filed. This time it's a single count of simple assault. Both sets of charges are based solely on the eye witness account of a single Deputy U.S. Marshal -- the same marshal in both cases.

Oddly enough, the second affidavit is completely at odds with the first one. Hmmm. Ain't that curious.
