Jim and I visited today.  Ed and Elaine tried to stuff us full of food and beverages.  There was a registered (certified?) letter from the supreme court at the Plainfield post office for Ed.  We got it for them.  I have little interest in legal technicalities, so didn't pay much attention to the details, but it was a refusal of some sort due to not having jumped through enough hoops.  Elaine gave me some points that might be useful at the sentencing hearing.  I'm gathering piles of material to bring up on April 24th. This thread and quest for a fair trial websites are a good start.

Peace, I did receive your voice mail in Concord later this afternoon, and this was after my attempt at opening a link in an e-mail to me from Wayne B. about this subject, and call too from Margot wondering what's up with Ed's latest radio broadcast about this +/or another* matter being investigated for a default too.  As it regards the website(s) I've yet to visit, I did call both Wayne B. and Dick M. for his nutshell version that the 10th Circuit out in Denver, Colorado had an IRS case where some 3rd party intervenor filed some set of interrogatories by some Rule 201 (?) that "shall" be answered by the government, as in they must, as their mandatory duty supply the answers or the case is over by some default judgment, as supposedly signed by the judge and by the Full Faith and Credit clause of the U.S. Constitution somehow a case-law case applicable to everyone including Ed & Elaine, but just in case this is not so, but that withIN the #__ questions is that one "silver bullet"  one that they/ the gov't REFUSE to answer, and so would rather default as to NOT set a precidence outside that district, then maybe for Elaine's court-appointed stand-by counsel, Bjorn Lang, in Concord (who Magistrate Muirhead said was "the" best in the state in the Ridley case), to file the same wording here, and get to a default too. To wait and see what Ed & Elaine do about this.

P.S. Today I did also visit the new Concord, N.H. Postmaster woman at about 5:00 o'clock p.m., and she gave me the old "Shultz" routine from Hogan's Heroes of: I know nothing, in regards to my written complaint to her predecessor, Bill Abbott, on vacation.  She wanted to hear verbally of what it was about, and I told her: I have a Postal Money Order in the exact amount of: $1501 and that I "demand" it be paid in lawful money, as her operations there "shall" comply with the Coinage Act of 1792.  She said to get lost, and go to the bank, as her place of business was only to sell postage stamps, etc. My request that she contact her bosses about this for a 2nd opinion: DENIED! so there! just what I wanted: for WHERE does the buck stop? The buck stops there.  The sawbucks ($10.00 bills, etc.) in the form of paper being exchanged for more green paper. The end result: THEFT! on her part, as the one to report to the Merrimack County Attorney for a Class A felony.  See my Reply #___ above at page #____ at exactly __:__ AM/PM (*) that started this project to find out whether the U.S. Government (Post Office) is keeping its books in the money of account as required by the law.  It isn't so she is a THIEF, and instead of processing it to her superiors, she takes the fall!

I'm not sure what they are wanting folks to do on the 24th but I have been thinking about something else...

what are each of you going to do if they seize ed or elaine between now and then?  Or whenever... there is thought to be some pressure for them to seize them before apr 24th since there is so little precedent for a sentencing in absensia.

Not saying you need to tell everyone here what your plans are,  but it would be good to think about it and have a default plan. 

My request would be that everyone simply have something planned and ready to go.  somehting constructive you will do on your initiative that you could do  within 48 hours of such a provocation. 

My default plan is to go as fast as I can to calendar.nhfree.com and schedule a flash demonstration at one of the federal facilities....give the media some kind of opposition to photograph at least.

If i'm short on time i'll just show up with exisisting signs.

if I have time maybe i'll do up a sign that matches the circumstance

--If you remember, it was Paul Gagnon, the former U.S. Marshal before Steven Monier, who said to the newspapers: that it's been 20+ years ago since the last person was sentenced in absentia, being Mr. ________ (unknown) [probably that attorney who embezzled $100s of thousands of dollars and took off to some foreign country, as told to me by Dick Bosa, of VOCALS, Inc. (R.I.P.)/ the former Mayor of Berlin, N.H.. where he was born] to compare to #___ other states and their statutes because according to http://en.wikipedia.org/wiki/In_absentia_%28law%29 for "In absentia under United States law" for  United States Supreme Court Rule 43 of 1946, revised in 1993 the defendant "shall" be present during both: "the return of the verdict" and "at the imposition of sentence" as the bench warrant was issued, but that the Marshal is under an oath to comply with only "lawful" precepts, and that by RSA Ch. 123:1 from Art.I,Sec.8,Cl.17 U.S.Const. the court is operating without its papers on file with Bill Gardner's (*) Office http://www.state.nh.us and so an unlawful and illegal court, and with my criminal complaint against them for serving an "Unlawful simulation of official process" by RSA Ch. ____ [see my Reply #__ above], they do not want to compound the situation to what may be a felony conviction* against him or them #__ officers who effected Ed's first unlawful and illegal arrest.

--WHERE and WHAT are our state of New Hampshire "public servants" doing about this situation? as a check and balance to our 2 federal Reps too plus 2 U.S. Senators, as this is "their" Congressional Court.  I have been to Carol Shea-Porter's Manchester office (on Lowell Street east of Elm St.) to try to get a meeting with her on this, and Scott there says that her last public appearance to meet the public was at St. A's BEFORE the election, and she does not "give a shit" what happens to the people now that she has been sworn in to her oath to abide by the Constitution, that sets it up by Art. I, Sec. 8, Cl. 17 for the states to first give their "consent" BEFORE the Feds can OWN and operate in ANY state, each state having their own mechanisms of HOW that is to be done (see Reply #___ above for the link to the state list with answers), here in N.H. it's with the Secretary of State(*) and the governor is in charge and RESPONSIBLE for the faithful execution of the laws by Articles 41+ 51, but that he is in effect telling the Federal court: go ahead, railroad our state citizen Ed Brown, as the people do not care whether I violate my oath or not, them too stupid or scared to impeach me by Articles 17+ 40, Part 2 of the New Hampshire Constitution.

--So David, that is WHERE I'll be: over at the General Court: getting State Rep(s) and Senator(s) [only one needed to start the process] to sign my Art. 32 Petition with their District number by House Rule 36, for the House Speaker to "prompt"ly process by Art. 14 and Rule 4 to the appropriate committee, for a public hearing on it, so that my proof of January 11th '07 signed by David Scanlon, the Deputy Secretary of State saying that there has been NO filing of the required RSA 123:1 documents by the Feds, and so PROOF of them owning AND operating as BOTH unlawful AND illegal.  Section :2 of tax exemption told to me by the Manchester Assessor, Mr. Cornell in person on Tuesday afternoon at his office after our demonstration with Bill Miller being that he either surmised or was told: that it's a "stand-alone" statute BUT that he is WRONG!**

What will you do if the Feds raid Ed Brown?

As many of you may be aware, Washington is thought to be under some pressure to have tax protesters Ed and Elaine Brown in the courthouse for their sentencing April 24.  The Plainfield, New Hampshire couple have been holed up in their house since their convicition on tax charges in Januray.  Ed is carrying a .45 and has promised to fire upon any government agent attempting to arrest him or his wife.  Ed's not perfect, but at least he's taking a stand and hasn't harmed anyone. 

I'm told it will be an a very unusual ocurrance if they are sentenced in absentia.   On the other hand, authorities have repeatedly stated they will not initiate an armed confrontation.

In any case we should be especially ready for the possibility of a raid sometime in the next few weeks, and we should each be considering what we are going to do if it ocurrs.  I tend to think that the best things to do are those which we do on our own iniatiative, and which are telegraphed to the authorities in advance.   However if you are just hunting around for ideas, or you don't have all the information you need to carry out some type of response...This post should assist you even if you're outside New Hampshire.

Here is a list of potential action items which would be appropriate and practical to carry out during the first 48 hours after an attack. Some of them you can carry out now.

1) Go to calendar.nhfree.com and see what types of flash events have been scheduled to occur in response to the raid. Attend them or promote them if you can.

2) Head to your nearest Federal facility with a sign of some type.   Plan on being alone at first.  Staples has good sign making material...big posterboards are best with lettering at least six inches tall, otherwise car traffic will not be able to read your sign.   Better to have this material on hand now, so you are not scrambling to acquire it after the spit hits the fan.  You will be three times as effective and visible if you also have a rattlesnake flag and pole.  If you need to buy those; e-mail me at dave97635 (that's a hotmail dotcom address).  I accept both Fed dollars and precious metals.  I'm posting below some ideas for signs.

3) Write a letter to the editor of a nearby paper expressing your concern.  In New Hampshire The Concord Monitor, Keene Free Press and the Union Leader seem to print most of the pro liberty letters they receive, and you can be from anywhere in the state.  The Keene Sentinel seems to be pretty good about printing our letters if written from the Keene area.  Keep them under 200 words in all cases if possible, especially with the Union Leader.

4) Join some political web forums and voice there your support for Ed and Elaine.  I've included a list of good forums below.  Better to join now and be ready than to join after the event.

5) Call relevant officials to express your concern.  I've included a list below.

6) Maybe go to Ed Brown's house?  Haven't really given this much thought. Certainly I hope more folks will go there beforehand as a deterrent.  His address: 401 Center of Town Road  Plainfield, New Hampshire 03781

But again...the important thing is to be ready, and do *something* constructive in response to any raid or seizure of our flinty acquaintence.

For those who are wondering what my plans are for the first 48 hours after a raid...my default plan is to go straight to calendar.nhfree.com and set up a couple of demonstrations to ocurr within that time frame.  These will likely be protests in front of Federal facilities in Manchester, Nashua or Keene.   Then I'll probably start working on new signs that match the new situation, and endeavor to attend the demonstrations.    Subject to certain change, that's my default plan.  What's yours?

Are you sure this is right?  I spent a few minutes on Google and found dozens of recent US District Court cases where the defendant was sentenced in absentia.

The judge in this case also had few reservations about trying Ed Brown in absentia, if that's any indication.

the feds could just try any of us in absentia and then just bomb our homes .... so much cleaner and no marshals hurt .... there would be colateral damage, but that cannot be helped.
