--This issue pertains to the New Hampshire statute, RSA 123(:1 * AND 40USC255 as interpreted by the Adams case of 1943 in The U.S. Supreme Court) which (Sven Wiberg, the Portsmouth Attorney for Dan Riley raised in court [see transcript of this and the "side-bar" at pages #___-___] by TRYing to present to you a copy of the N.H. Art. 49 Petition that you signed on June 20, 2007 that) Joe Haas raised (BEFORE the jury verdict in what was supposed to be a 6th Amendment  public trial down to a "nadir" amount for his "Point of Order" that three (3) "other"/First Circuit Judges ruled was AFTER the verdict, BUT that they REFUSED to correct their Order upon Mr. Haas's Correction by way of his Motion to Reconsider).  I'm not SURE it has much possibility of winning, (IF you get these same THREE judges) but I think there may be a territorial jurisdiction issue that should be raised (such as: (1) when your Texas Attorney should have argued this on The Removal part of your case but didn't and so is "ineffective assistance of counsel" and; (2) when you were trucked over to Portland, Maine even AFTER Assistant U.S. Attorney Arnold Huftallen KNEW it was illegal, as against 18USC3232 withOUT your approval in writing, since he did make this offer of waiver to you in writing, of which Mr. Haas has the actual signed documentation that was NEVER allowed to be the OTHER Point of Order #2 that was planned AFTER the first point of order: Judge Singal never even allowing Mr. Haas the opportunity to talk about it, him being promptly arrested by assault upon him by the pushing of Deputy U.S. Attorney Jamie Barrie, to out of the courtroom #4, who he did take a criminal case of Simple Assault to the Concord District Court, and Barrie NEVER showed up for his arraignment after being served by Deputy Sheriff, and so a "conspiracy" between Judge Edwin W. Kelly, the Chief Judge of all of the N.H. District Courts thinking what? that in-cludes the U.S. "District" court too?, and his use of the sole dissenting opinion in a case referencing the State (by Haas) v.s. Rollins case to say that private prosecutions for Official Oppression type cases are NOT allowed! - Mr. Haas, I've been told is seeking an Art. 17 House Bill of Impeachment for Senate Trial by Art. 38 against this Edwin W. Kelly of Plymouth, his former Ashland tenant's attorney, with a hearing later this month before the Legislator's Council for the [Art. 32] Petition for Redress of Grievance (by House Rules 36 + 4).)

about WHEN the next Tax Collectors meeting is scheduled to occur, (next Annual Conference this November 18-19, 2009) because something has got to be done about when the Feds do acquire a property for seizure of a "secure hold" of this part of the purchase definition of the word toward a forfeiture per 40USC255 and that of how they can get-away with NOT paying the property taxes...

...for the the last part of 2007 (since Oct. 4th), all of 2008, and to today being 7 1/3rd months to August 10th, and so over 2.5 months + 12 + over 7 = over 21.5 months so far.

To maybe have a State Rep. put in an L.S.R. #_____ for a House Bill #_____ next month for Year 2010 Legislation dealing with this!

since the Plainfield Tax Collector is still sending the property tax bills to the corporate owner of record rather than the ones who have left the land fallow*!

What a bunch of crap! I called The City of Dover Tax Collector's office, and found out that she is out all week, the Deputy Susan * is out-to-lunch to about 2:00 p.m. (then back to work for another 2 hrs. to their 4 p.m. closing time), but that the billing is done by the Assessing Dept., so said Denise at Tax Collecting over to Jane in Assessing who referred me over to Kim who said that Mr. Lynch, the Finance Director who I've sent numerous e-mails too withOUT even an acknowledgment let alone a progress report to its completion from over a month ago to the Wed., Aug. 22 City Council Meeting @ 7:00 p.m. was not in either, and so she put me through to Attorney Krans' voice mail  at http://www.ci.dover.nh.us/cahome.htm to where I did leave a message that he please get back to me of WHY the law has not been upheld by this RSA Ch. 123:2 billing of the $47,000+ property tax to the Feds for their building there of the Post Office that is NOT exempt! This omission actually a crime if not done so in a "prompt" manner by Art. 14, and so there will be papers flying around there on Thursday of RSA Ch. 643:1 Official Oppression to the Dover District Court, by Private Prosecution, if I have to, since no feedback from the COP either getting numerous e-mails too, if I do not get some action on this like on Wednesday night. The Rule of Law to be upheld! None of this well- that's the way it is, that we don't "think" that it's proper for one branch of the government (City) to bill another branch, being the federal government, (especially when they are "nice" enough to send us $millions in federal revenue of our own money extracted or donated) but like I've been told on other matters before: if you don't like it then see your State Rep to change the statute, because as it stands now this IS the law, and I expect "law enforcement" to do something about those who neglect or purposely by being in-the-know now for criminal culpability to do their job, or if not, then they can sit it out over at the County Jail thinking about WHY somebody didn't give them a swift kick in the ass BEFORE so that they could be told what to do it.  Well, I told you so! "Thanks Fred.  I did just copy this out @ 80% onto three pages for future reference. This "Secretary" stuff in my 1983 case of the U.S.A. v. Joseph S. Haas that I won in U.S. District Court, Concord, N.H. (case #M.83-50-D for Chief Judge Shane Devine) was relayed by me to one of the three and Chief County Commissioners, George Maglaris, for Strafford County in Dover this past Sunday morning as I was checking out a Restaurant by his "George's Marina" in Dover for where to have lunch there maybe this Sun., Aug. 16 after hopefully visiting Ed & Elaine Brown at the Jail (with Bernie already on the list and approved who sees them most Sundays). I told George about when I did ask the I.R.S. agent on the witness stand with Clerk-turned Magistrate William Barry for WHO the "Secretary" was, and he said he could NOT answer the question as he did not know, with Barry's eyes rolling upward to the ceiling in disbelief and saying: case dismissed! The Feds wanting over $62,000 from me as a landlord, and me firing back with the Martin J. "Red" Beckman book of when he was running for President, of "The I.R.S. and the Black-Robed Mafia", that section (5) of the Code was and is unconstitutional! Re: of secondary investment income to land.

I've always "THOUGHT" that the Secretary was The Secretary of the U.S. Treasury, and have heard rumors of this Puerto Rico connectuon, but have never seen it spelled out so simple before. Re: like in the Title 26 chart "they" always say you make between $x and $y at this level of the chart and so pay $z amount, but that they always skip over the very first sentence of the chart ONLY applicable for those "liable" to pay the tax.  What makes me liable? is what Ed asked and keeps asking, withOUT any answer(s)!

No answers either, other than a DENIED, of his Motions for Discovery of the Jurisdictional authority for this inferior Court of Congress (an Article III, Section 1 "inferior Court" of Congress, that withOUT the 40USC255 papers of acceptance from our N.H. R.S.A. Ch. 123:1 offer they are operating over there illegally as outlaws, and by our very own Article 12-N.H. Constitution, the Law-Enforcement of the Town/City, County and State is supposed to protect us from such, since: "Nor are the inhabitants of this state controllable by any other laws than those to which they, or their representative body, have given their consent." Yes, we, by our General Court or Legislature did  give them our consent, but of what type?  A "conditional" consent, as yet to be fulfilled.

The County of Strafford, by their Commissioners by-passing this requirement and dealing with some woman in Washington on a contract to take in for holding federal inmates there at about what? $100.00 per day? To me this is:

The Internal Revenue Service is not an agency of the United States government. It is true that it is found in Title 31, Section 1321(15) as the 62nd Trust Fund of the Department of Treasury for Puerto Rico but it is nowhere to be found in the entirety of Title 5 U.S.C. for the United States Corporate Government.

Congress THOUGHT it created it but it did not. Just look at the 1100 manual and it tells you so. Congress only created the Commissioner's Office. He then hired the private collection agency people and used them as the tax collectors. In fact, I defy you to find any IRS employee listed as an Employee of the United States Government with a United States Employee Identification number that has been hired by any District Director in the country. Now I suggest you look at 27 Code of Federal Regulations Section 250.11 and therein you will find the definition of "Revenue agent." That definition reads "Any duly authorized Commonwealth Internal Revenue Agent of the Department of the Treasury of Puerto Rico."

I now refer you to the "Secretary" described in 26 U.S.C. 6301. Does it not state, "The Secretary shall collect the taxes imposed by the internal revenue laws?" Yes it does. Congress mandated this by 68A Stat 775 and you cannot disagree. Does not 26 U.S.C. state that this "Secretary" may make a return based on the information he has if a person does not make a return? Yes it does. Does not 26 U.S.C. 6001, 6011 and 6012 refer to this "Secretary?" Yes it does.

Now, if the Revenue agent decides to prosecute, he approaches the Attorney General and this "Secretary" as noted in 26 USC 7401 to prosecute upon concurrence between both the Attorney General and this "Secretary," is this not correct? Yes it is and all the above is undisputable. Is it now contrary to any rational man that this "Secretary" can only be one person and not many?

Now, I direct your attention to 27 CFR 250.11 again for the definition of "Secretary" as found in all the above. The defining term for "Secretary" is, "The Secretary of the Treasury of Puerto Rico." That man is Manual Diaz Saldana. Those revenue agents operating in all the states are not United States employees. The Statute mandated to be at the end of each regulation by one Code of Federal Regulations (CFR) is 68A State 775 (26 USC 6301).

I now direct your attention to the House of Representatives, 39th Congress, 2nd Session, Ex. Doc. 99, titled Salary Tax Upon Clerks to Postmasters, LETTER from THE SECRETARY OF THE TREASURY dated Feb. 20, 1867, referred to the House Ways and Means committee and ordered to be printed. I am now going to prove that the IRS agents are not now nor were they ever employees of the United States. You can obtain the document faster than the man on the street. The postmaster wanted to know why postal clerks had to pay income taxes and why the IRS clerks did not have to. The "clerks" are today called "revenue agents." I quote part of the response that is not taken out of context concerning the IRS employees. Why should I, because it is verifiable by anyone.

"No money is advanced by the United States for the payment of such salaries, nor do the assessors perform the duties of disbursing agents of the United States in paying their clerks. The entire amount allowed is paid directly to the assessor, and he is not accountable to the United States for its payment to his clerks, for the reason he has paid them in advance, out of his own funds, and this is reimbursement to him of such amount as the department decides to be reasonable. No salary tax is therefore collected, or required by the Treasury Department to be accounted for, or paid, on account of payments to assessors' clerks, as the United States pays no such clerks nor has them in its employ or service, and they do not come within the provisions of existing laws imposing such a tax." This was signed by H. McCULLOCH Secretary of the Treasury.

Then to clarify it he included Section 165 which states that the only people to pay income taxes are, and I quote: "persons in the civil, military, naval, or other employment service of the United States, including senators, representatives and delegates in Congress."

Since the postal clerks are paid by the United States and the IRS agents were not, those revenue agents were just like me and the millions that do not work or contract with the United States. Therefore, they were not subject to the income tax. Moreover, it is today, and that explains why the private collection agency agents cannot be sued under 26 USC 7214 because they are not employees of the United States. Today they are based and under the direction of the Secretary of the Treasury of Puerto Rico, strictly to collect alcohol, tobacco, and firearms taxable activities.

The identity of the Secretary is not found in title 26 U.S.C. The only reference to the identity of the Secretary of the Treasury is in 27 C.F.R. at section 250.11 (definitions) that specifically states: "Secretary means Secretary of the Treasury of Puerto Rico".

He's the head honcho. In addition, you are usually dealing with an agent with a title of "Revenue Agent." The only definition of revenue agent is in 27 C.F.R.section 250.11 and is defined as: "Revenue Agent means any duly authorized Commonwealth Internal Revenue Agent of the Department of the Treasury of Puerto Rico."
