Lauren was kidnapped on the 101 bridge that crosses Ponemah Hill Rd. in Milford ...she likes red.

if Lauren is facing a contempt charge  then the question is   is that civil contempt or criminal contempt   if it is civil contempt , then she needs to see the contract between the judge and herself that she is in contempt of       if it is criminal contempt   then she needs to see the certified complaint      or there is no contempt

I dreamed Lauren was dead.  She was lying on a stone slab in a small, grey, stone room.  She was very cold and ashen.  I was wearing the armor of a black knight and I killed two dogs that where in the room.  Lauren started yelling at me... that the dogs where not the ones hurting her.  At that point I was startled awake.    :o

Look, it's called a "WARRANTLESS ARREST".  How could the cop possibly KNOW she didn't have a license until he made her stop?  What was the precipitating cause of the contact in the first place?  Here in California there are two sections in the Vehicle Code that PROHIBIT a cop from pulling someone over to see if they have a license.  SO I'd go through the Vehicle Code in your state and find the "enabling language" whereby a cop can pull someone over to see if they're licensed.  If the cop acted without authorization then the stop was VOID!

"'To be valid, administrative action must be within the scope of authority conferred by the enabling statutes. . . .' . . . 'If the court determines that a challenged administrative action was not authorized by or is inconsistent with acts of the Legislature, that action is void.'" (US Ecology, Inc. v. State of California (2001) 92 Cal.App.4th 113, 131-132.)

Just cuz this is what the Cal Court of Appeal held doesn't mean it's not the same everywhere. Check your case law and use it against them.

Further, the "WARRANTLESS ARREST" is prima facie illegal!  If she wasn't free to break off contact with the cop then she was "SEIZED/ARRESTED".  Attack the stop as unconstitutional because the cop didn't have a warrant.  She was subjected to false imprisonment.  She can file a claim against the cop for damages.

Defendant makes a prima facie case of unlawful arrest when he establishes that arrest was made without a warrant, and burden rests on prosecution to show proper justification.

Ok, being stopped for speeding or anything else is still a "WARRANTLESS ARREST" no matter how you cut it.  The 4th Amendment is implicated as well.

The United States Supreme Court has identified three categories of police contact with persons. The first is referred to as a "consensual encounter" in which there is no restraint on the person's liberty. There need be no objective justification for such an encounter. The second type, called "detention," involves a seizure of the individual for a limited duration and for limited purposes. A constitutionally acceptable detention can occur "if there is an articulable suspicion that a person has committed or is about to commit a crime." The third type involves seizures in the nature of an arrest, which may occur only if the police have probable cause to arrest the person for a crime. (Florida v. Royer, supra, 460 U.S. 491; Wilson v. Superior Court, supra, 34 Cal.3d 777.)

Is speeding a "crime" where you live?  Here in Cal it's an infraction which isn't criminal.  If speeding isn't a "crime" where you live then the cop violated his oath because he applied the State's police power to NONcriminal conduct.  That's also a violation of the Separation of Powers doctrine because he made up law.  He's not a member of the Legislative branch so he doesn't get to make law.

Most of you already know this so to you it's going to sound like I'm stating the obvious, but I just want to make sure everyone knows, including perhaps some of the shy lurkers that don't post much.

Lauren is making huge sacrifices for the liberty movement. I know she has taken some criticism from people who don't think what she's doing is going to accomplish anything. Well they could be right. If WE don't get her message out about the growing police state, then we have failed her. I already feel like I'm not doing nearly enough. I'm planning to make the first entry (a cartoon and blog entry) in my website about Lauren. We need to be out in front of the jail a lot. I've only been once myself. But I think it's even more important to get info out into the media where we can really reach a lot of people.

I'm embarrassed to say that part of this probably comes from feelings of guilt that I don't have the courage that Lauren has. Seems like the least I can do is back her up. OK, off my soapbox now.

It is impossible to travel secondary highways without speeding.  Every little village slows you down to 30mph, although only the inhabitants would know their was a village there.  There is seldom any activity.  I would guess that these speed limits were set 50 years or more ago when most sport cars didn't handle or stop as well as an average modern compact does today.

"Lawful request" doesn't mean you have to answer nor can you be punished for remaining silent.  A REQUEST and DEMAND are two different things. 

The fact remains, the cop made a "WARRANTLESS ARREST".  Is speeding a crime, yes or no?  If it's not then the cop has a big problem.  Unless of course you want to focus on irrelevant issues like "lawful request".
