Jury Selection in State v. King Monday 5 June; State hides evidence.

Here is a story from the Peterborough Transcript outlining the case of attempted felony extortion against me:

Well here we go again, folks. At a hearing on Wednesday 1 June Judge Arnold -- who clearly cannot stand me -- threatened that he would not compel the state to produce the copy of Chief Dunn's Deposition in a Civil case (for Defamation of character) that he granted the State a continuance to obtain in the criminal case based on representations from Chief Dunn that it contained incriminating statements I made when I conducted it.

My lawyer, former lead prosecutor David Horan vows to file a Motion on Monday 5 June 2006 after Jury selection using my affidavit as to why

a) there is no inculpatory or incriminating evidence contained therein,
b) more importantly, there is exculpatory evidence all over the place.

Trial is 12 June 2006.

.....but just remember that the State brought up the issue of Chief Dunn's Deposition transcript on their own, and now they obtained a copy of it and it turns out that Chief Dunn must have been lying to them, because they don't plan to use it at trial -- even as they got a continuance from the Court to obtain it in the first damn place.

Let me make this simple: The Deposition is very damaging to Chief Dunn and the State's case and contains exculpatory evidence. Rule 98 requires the State to provide the Defendant a copy of any and all exculpatory evidence the State has. End of story.  But not when it comes to me, apparently. Interesting.  Here's a clip from the Affidavit:

2. I studied contracts under Juliet Kostritsky, and Evidence under Paul C. Gianelli, Esq. author of substantial sections of Ohio Criminal & Evidence Code, who taught us that bias and credibility of any witness is always relevant;

4. I believe Chief Dunn?s Deposition that I conducted at Hillsborough Superior Court South on or about 18 November 2005 contains substantial exculpatory evidence going to my state of mind at the time of the alleged offense, and going to Chief Dunn and Charlie Bauer?s lack of professionalism or candor as well as their bias for the following reasons, which are only a partial list of items I could recall from notes and memory:

a. At the outset as seen by the record comments during Depo. Exhibit 1, Chief Dunn and Attorney Charlie Bauer thought that a piece of hate mail I received was ?funny? in their own words. The hate mail as Depo. Exhibit 1 contained a direct reference to me being gang-raped in prison and what my rectum would resemble......

On a side note, I wonder what the percentage of black NH residents is who are incarcerated or on probation... is it higher than other states?

Depends there are probably a lot less of them than in other states, Ian BTW I just read a African-American oriented newspaper on the commuter train today and check this:

1. Georgia + New Orleans= FULLY 1% OF TOTAL POPULATION IS ENCARCERATED! (scary isn't it?)

2. Lowest-crime states include NH, and most have liberal (in the good way) gun laws (what's VT's status?).

3. Approximately 1,000 inmates are added PER WEEK nationwide. Most are the usual suspects as we all know. BTW, Kubby says 'hi'.

Damn, I forgot to note that the officer Dunn fired several months ago won his reckless ops case, but Dunn's still on him for witness tampering. I bet it's a bullshit charge.  MASS Cops called Dunn a slime-bag.  There's a link to that here:

Dunn lies again.

First he thoroughly understands email, then he has no clue as to how he sent a very nasty email to the entire East Coast NAACP brass, despite using email for 7 years "maybe more."
