But in the case of the STate being "trustee" the answer is yes, because they state has no such Fiduciary responsibility to the citizens and tax-payers. If the water becomes worth less because of mis-management -- they'll just tax more to make up for it.

that is what a "trustee" means...

the economic rent is set by the market...

There is only 18 miles of coastline in NH. I want to own it all.

I was just at Lake Winnipesaukee this past week.  'public' access seems very far apart and the state wants to charge a few to put a boat in.

Lot of Ahole boaters on the Lake this weekend.

My boss, a frenche from Mass, said his crew used to go up to the lake every weekend in the summer.  Most of those aholes are likely massholes  :D

the commons is between high and low waterline...

both Squam and Sunapee had very public fights about being required by the state to provide more public access...

Indeed because my friend with the boat is from MA.  Although he is a Masshole he does know the rules of boating.

Okay, then it is deceptive to say that the commons are only between the high-water mark and the low-water mark, because "public access" to the shores also entails some sort of common ownership between the roads and the shores which cannot be privately owned.
