He's out!!
The judge sentenced him to "time served, no probation, no fine, and the $20 special assessment fee".
(I have no idea that that $20 fee is)

Sounds like the cost of the paperwork (minimal in this case).

I arrived at the courthouse about 5 minutes to 3:00PM
Interestingly, this time they kept my iPod at the door. I guess I shouldn't have posted about the ipod-recording-thingy, eh?

I arrived in Courtroom #4 at 3:00 PM sharp.
There were about 16 people there that I recognized, not including Russ (of course), the ICE agent, and the court clerk (who was the same lady that was the clerk at the trial itself)
Russ was in the classic "prisoner orange" outfit. He was indeed wearing glasses.

Judge (same judge from the trial) entered the room at about 3:03 PM: "all rise"
I think everyone did rise... except Russ.

"Case 07J7401 USA vs. Kanning"
The Judge asked if there were any objections to the report that had been filed (I presume that would be the transcript of the hearing, plus supplementary documents).
Government counsel: "no"
Russ didn't answer.

Judge: "have you received the report?"
Russ nodded.
The judge, obviously flustered, asked "did that nod mean you have read the report?"
He then said that if he hadn't, they would have to recess until he did receive it.
Russ said "yeah, I got it"

The Judge then explained that the report would be kept under seal unless an appeal of the case was made.

Judge: "any disputes?"
Gov't: "no"
Russ: "no"

Judge: "any legal findings to report?"
Gov't: "no"
Russ: "no"

The Judge then said something to the effect that these preceedings were not controlled by any sentencing guidelines (I guess that means there was no minimum sentencing in effect)
Judge: "any additional arguments to file?"
Gov't: "no"
Russ: "no"

Judge: "Anything you wish to say before sentencing?"
Gov't: "no"
Russ: "no"

The judge then gave the sentence:
Time served.
No Probation.
No fine.
$20 special asessment fee

The Judge asked if there was any reason for the sentence not to be thus.
Gov't: "no"
Russ: "no"

The judge informed Russ of his right to appeal the sentence, hich appearently must be filed within the next 10 days, and that there was some kind of special consideration if he did not have the funds to do so.

3:07 PM, "all rise", we file out.
All done.

That appears not to be the case.
He walked out of the courthouse in his own clothes and then, after a photo-op session with Roger Grant, set out with the group to find a place to eat.

"Victim" fund... oh, the irony. You think Russell and Kat should apply to get paid from this fund?

By reducing the assessment, the judge was making a statement about the severity of the "crime".
