Londonderrry landowners lose eminent domain case

December 18, 2006

LONDONDERRY, N.H. --Three landowners have lost their Superior Court fight against the state in an eminent domain case.

The Transportation Department took about 15 acres as part of its plan to build an access road to Manchester-Boston Regional Airport.

Rockingham County Superior Court Judge Robert Morrill rejected the challenge, then denied a request that he reconsider. He ruled taking the land by eminent domain was justified because the land would be for a public use.

Landowner Al Baldasaro called it a land grab and thievery. He and the other landowners say the state does not need their land and did not offer enough.

The state plans to use the land to make up for wetlands that will be filled for the project >:(.

Baldasaro said he hasn't decided whether to appeal to the state Supreme Court.

The crazy thing is that the land is NOT for the road.. it is to 'make up for the wetlands'  what a piece of crap....

Al has become quite active in the RLC-NH since this issue forced him to take some kind of action.
If I recall correctly, he didn't win his primary, but it was close.

wetlands are connected with our groundwater supply which is managed as an integrated whole owned in common as an individual equal access opportunity right with the state as the public trustee.

the state's role as the public trustee is limited to:

1. protect the integrity of the groundwater as an integrated whole for future generations
2. protect each individual's rights of equal access.

land which original starts out as owned in common is privately enclosed for exclusive use via privilege (private law) with the justification that it enhances the common good - why else would we do it?

if it can be shown objectively that taking back the privilege of exclusive use via market value compensation and returning the common right of way that will exist within the collectively owned road (as it did across all land prior to exclusive use) enhances the common good then the use of force to accomplish this is justified just as the use of force to establish and maintain the privilege of exclusive use is justified by enhancing the common good (private exlusive use leads to surpluses that can support several multiples of people over the numbers that can be supported via hunting and gathering tribalism).

 :'(I did not get the opportunity to step in to the court house at all. It cost me $10,600.00 for this case and I did not even get the chance to be heard. This is a disgrace for our courts to not even listen to me. The state (Fish & Game) floods my land by a dam, they condem it at no value to build, their lease expired and then they steal it on a DOT mitigation bulls_ _t program for the airport access road, when they are not building anything on my land and the access road is about 6 miles away from me.

They stated that they are protecting the enviromrnt, well if that is the case, why did they NOT buy the junk yard that sits right next to the manmade wetlands?

Keep in mind, this was a land grab of 780 Acres not 15. My land has a creek in the back and the land is flooded because of the dam that fish and game put in 50 years ago. They took 5 acres of land, which some is high land, which knocks out my frontage required to build a home there, for on of my children

When the town put in the conservation overlay district, this stripped me of my rights to build a house on either side of me for my childrens future. I do not know if the town has the right to restrict me from building anything within the buffer, which is 100 feet. They did it, so now it takes away my value of the lots and right to build.

I could go to the suprem court, but this could cost me another $10,000.00 and I might never get the chance to be heard. My next avenue of approach is to get a appraisal of what my land would be worth and go to the land and tax appeals board for value. I still stand by the fact that my land is not for sale and that now, they left me no choice but to go to the board.

If I could afford it, I would take the gamble and go to the Suprem court but I have to face reality that I could lose monies that I do not have and eventually lose everything.

As a State Rep, I have the opportunity to hold people accountable, so it does not happen again. I did testify on the Emminent Domain bil that eventually made it to the ballot and passed.
