I received this e-mail from the Constitution Party chapter here in Texas, and it's scary as hell to think that a senator from neighboring Dallas - a Republican one at that - even thought of this:

On December 15, 2006, I sent letters to both Texas State Senate Lieutenant Governor David Dewhurst and Texas House Speaker Representative Tom Craddick asking the source that charged them with the duty to make the Texas Uniform Planned Communities Act (referred to as TUPCA), the enabling statue for Texas and the reason for appointment of Senator John Carona (of Dallas), to the 80th Texas Legislative Counsel.

.my reason for contacting you today is for your immediate answer to two questions.

First, the source from which you received your charged duty of the above TUPCA, which in turn you charged to the above Senate interim Committee.
Second, reason for your appointment of TUPCA's original author Senator John Carona to the 80th Texas Legislative Council.

The Texas Uniform Planned Communities Act (TUPCA) will bring about full implementation of "land use" laws, change of title tenure and creates management of private property and it's owners. It is a statue enabling comprehensive, uniform framework for creation, development, operation, and management for planned development of "sustainable" human settlement communities through out all rural/urban Texas. Agenda 21, Millennium Declaration Goals. I am well versed in this area.

Since you have charged this duty, then you have read the proposed Act and are fully aware of it's intent, implications, and sections which are in complete violation against our Texas Constitution. It's stripping of individual states constitutions as well as our Constitution of the United States, as law of this land, forever. Texans will be subject to international law and governance.

In closing let me say, the public is intentionally being misled anytime this is referenced as "HOA." When it has been testified to be a "sustainable" private property & business ownership statute. Your immediate response is appreciated.

On December 19th I received Lt. Gov. Dewhurst's response withholding the information I requested and as of the date of this article, I've yet to hear from Rep. Craddick.

Thank you for taking the time to send me your comments on the proposed Texas Uniform Planned Community Act (TUPCA). I appreciate knowing of your opposition to this measure, which was studied by the Senate Committee on Intergovernmental Relations. As you may know, the committee recently released its report to the 80th Legislature. Due to strong opposition, the committee did not recommend adoption of the act, though it did recommend several non-controversial provisions. The report can be accessed at www.senate.state.tx.us.

Carolyn Scott is the policy analyst in my office who is following this issue. I have referred your letter to her and instructed her to note your opposition to TUPCA. You are welcome to contact her if you have additional comments or ideas that you would like for us to consider.

TUPCA creates Texas into a managed "sustainable" society of human settlements under one uniform set of international laws in every aspect of our life, environment, and resources. We are incorporated "associations" created by local state government enacting an enabling statue that mandates private-parties to create "open-end contracts" of restrictive covenant laws running with all urban and rural land, without exceptions. Within these "contracts" (restrictions) is a "trustee" holding a lien against the property for it's future taking by judicial/non-judicial foreclosure for any restriction "violation" or  monetary "obligation" as determined by the trustee, as well as power of property condemnation.

Senator Carona was the original author who presented TUPCA to the 79th Legislative Counsel who then drafted it into it's present original legal form and wording to be a filed bill during that session. However, it was pulled the 11th hour from filing with plans to re-submit to the 80th Legislative session after gaining needed support. And, which would be after elections I might add. He now sits in a prime position for TUPCA.

January 6, 2006, Senator Carona's E-mail Update:

"I am pleased to tell you that the Lt. Governor has appointed me to the Texas Legislative Council, which provides bill drafting, computing, research, publishing, and document distribution services to the Texas Legislature and legislative agencies. The council also serves as an information resource for state agencies, the citizens of Texas, and others as time and resources allow".
The fact he is CEO of "Associa" which claims to be the largest full service management corporation across this nation, has it's own training university, and solicits to be contacted by other industry vendors wanting to sell their companies. Furthermore, he is a member of the Community Association Institute (CAI) formed by the National Association of REALTORS, Urban Land Institute, FHA, HUD, VA, National Association of Home Builders, US League of Savings & Loan Associations. Many of these are UN accredited NGOs (non-governmental agencies) and some are US Government agencies to the UN.

The Texas 79th legislature interim committees of the Senate Intergovernmental Relations, and the joint House Land & Resource Management with Business & Industry held their public hearings on  the original TUPCA proposal and their reports of recommendations for the 80th legislative session can now be viewed online at the following links.

Any filed bills are uncertain at this time and common practice in Austin is to simply take sections from one bill and implement into another bill, perhaps even through another committee. Also to attach amendment on the floor and even to another bill, and then come back each session for further implementation. This disables the few common citizens who attempt to track and counter such attempts from stopping it's passage.

According to the Texas College of Real Estate Attorneys (TUPCA's creators),  "After TUPCA becomes law and we know which homeowner rights survive the legislative process,..will prepare a bill to amend Texas Uniform Condominium Act in the next legislative session". 

TUPCA is Texas's implementation of the 1976 Vancouver Declaration of land use laws adopted at the UN Conference on Human Settlements-Habitat, and the 1992 Agenda 21 (now called "Local Agenda 21" by our city/county officials) of "how to" recommendations presented at the UN Conference on Human Settlements-Habitat II. Representatives, including US Presidents, signed agreements to support implementation of the recommendations. Agenda 21 has never been ratified by US Congress. It was later developed into a condensed "soft law" known as "Millennium Development Goals" (MDGs), and every 2 years the US Government reports it's progress to the UN. 

When reading the preamble of TUPCA switching back and forth from "the" to "this" state or residents, a red flag went up.  In UN documents "the" state is the UN's state of North America/US, and Texas is a local state/region or territory within that UN state. 

Section 1. The legislature finds that:


(1) it is in the best interests of the state and the residents of the state ...
(3) it is in the best interests of this state and the residents of the state .
(4) it is in the best interests of this state's local political subdivisions and residents of those subdivisions.

The North American Alliance and open borders will further the implementation of voluntary or involuntary resettlement for population distribution in human settlements where everything will be common interest public ownership under public-private sectors operation and management control.

Vancouver Declaration, D. Land (Agenda item 10(d)) Preamble:


1. "Land.cannot be treated as an ordinary asset, controlled by individuals and subject to the pressures and inefficiencies of the market. Privateland ownership is also principal instrument of accumulation and concentration of wealth and therefore contributes to social justice; if unchecked, it may become a major obstacle in the planning and implementation of development schemes. The provision of decent dwellings and healthy conditions for the people can only be achieved if land is used in the interests of society as a whole. Public control of land use is therefore indispensable."
Recommendation A.1
(b) All countries should establish as a matter of urgency a national policy on human settlements, embodying the distribution of population.over the national territory.
(c)(v) Such a policy should be devised to facilitate population redistribution to accord with the availability of resources.
Recommendation D.1
(a) Public ownership or effective control of land in the public interest is the single most important means of. achieving a more equitable distribution of the benefits of development whilst assuring that environmental impacts are considered.
(b) Land is a scarce resource whose management should be subject to public surveillance or control in the interest of the nation.
(d) Governments must maintain full jurisdiction and exercise complete sovereignty over such land with a view to freely planning development of human settlements..

50.(e) establish and adopt a regulatory framework, and provide institutional support for facilitating participation and partnership arrangements al all levels;
56.(k) Develop land codes and legal framework that define the nature of land and real property and the rights that are formally recognized;
58.To eradicate legal and social barriers to the [equal and equitable] access to land, especially the access of women, people with disabilities and other vulnerable groups, Governments, at the appropriate levels, in partnership with the private sector, non-governmental organizations, the cooperative sector and community-based organizations.
59.(a) Adopt an enabling legal and regulatory framework based on an enhanced knowledge, understanding and acceptance of existing practices and land delivery mechanisms so as to stimulate partnerships with the private business and community sectors, specifying recognized types of land tenure and prescribing procedures for the regularization of tenure, where needed;
(c) Explore innovative arrangements to enhance the security of tenure.in the absence of a conventional title to land;
61.(e) Establish, where necessary, a comprehensive and detailed body of property law and property rights, and enforce foreclosure laws to facilitate private-sector participation.
