Is Marple a rep again?  I thought he lost.
You are correct. The General Election of one, District 9 Merrimack, being counted by one machine, had me with a 9 vote lead over the Ex-chief of Police. The following Monday a recount was requested and the last week of November the ballots were opened and revealed mysteriously an additional 51 uncounted ballots appeared?  I ended up losing by 3 ballots. Carol McGuire was one of the counters.   Dick Marple

Handing FIJA pamphlets to potential jurors would be a great idea.

I know that many prosecutors (funny how it's always the prosecutors) have complained and sometimes successfully argued that handing out pamphlets may be construed as 'jury tampering'.  I always thought that Voir Dire was jury tampering.  ;)

If a judge says to a jury "you may only consider the law as it is written.  You may not judge the law itself'  how come that isn't a crime?  A judge should never be allowed to lie to anyone in a court room.  I would think judges that lie to juries in regards to nullification are committing treason...

hey how about this instead....what if i were to just announce that i will enter the jury pool area and inform the jurors of their rights?

btw great to have you here dick/armlaw!

I'm of the opinion that the URI by itself is fairly useless, as it is both nondescript and an acronym.

Dada's sign idea, though, is something I think is quite good. :)

It's great as part of a pervasive strategy to get the info in front of jurors.
If a dozen people are wearing the URL on T-shirts, painted on the foreheads, writing it in chalk on the sidewalk.. you don't think people would go have a look on the internet?

Here's a draft news release which includes a draft letter to the as yet unselected judge.   Still haven't settled on doing this or where but moving in that direction.
would welcome your thoughts on improving the release.

"It is not only (a juror's) right but also his duty... to find the verdict according to his own best understanding, judgment, and conscience, though in direct opposition to the direction of the court."

-  President John Adams

Judge John Doe
XYZ court

Dear Judge Doe:

I wanted to let you know I intend to enter your facility on _____ at ___ a.m. and committ a harmless but controversial act of civil disobedience.  My plan is to enter the room where you hold your jury pool, and carry out a duty you and most judges have been neglecting.  I'll hold a sign which reads:

"Juries may overule judges"
FIJA.org"

If you wish to stop me you have two options:

1) Arrest me
2) Sign an affidavit pledging you'll start informing juries of their nullification rights

I intend no disrespect, bear no personal animosity and wish to believe you're a good person with good intentions.

But it's wrong for you to yank jurors away from their lives and jobs, only to willfully keep them in the dark regarding their rights and powers.  It gives the impression you covet these powers for yourself and that you prefer guilty verdicts.

The concentration of authority in the hands of judges has filled our jails with persons who have - in many cases - committed only victimless "crimes."   And it has forced taxpayers to foot the bill.   It has forced *me* to help you lock people up for owning unapproved plants, engaging in peaceable commerce, even for exercising constitutionally enumerated rights.

Historically, jury nullification helped Americans get rid of alchohol prohibition, and ______.    Nearly all citizens used to be aware of their nullification rights, and it only takes one principled juror to trigger mistrial when the government tries to enforce a bad law.  Jurors are traditionally the last line of defense against tyranny.

But more recently, many Americans have fallen into a state of ignorance and subservience, believing that they must do whatever a judge tells them.   Some judges even expel jurors for learning the simple truth about their rights.

I urge you to take the opposite approach.  If you wish to do the right thing and present me with the requested affidavit, give me a ring and we can work something out.

If you choose to deploy policy enforcement officers against me, I will treat them with kindness and respect but will peaceably disobey their orders.  I will gently continue attempting to enter the jury room until I am physically restrained and dragged from the scene.

Despite your efforts to keep jurors ignorant, they still have the right to judge the law, the case, and you.   If you won't inform them of that right, I will.

Respectfully,

Dave Ridley

Keene has a paper friendly to the idea of overruling bad law, via a jury.   ;D  That may make it a good town to do it in.   8)
In fact, it may be possible to get some of the more liberal activists in the area to join.
Not sure I like the idea of an 'unauthorized joining of a jury', but that should break into at least some of the mainstream media.

Recumbent ReCycler

Dave, I suspect that if you told the judge in advance that you were going to enter the courthouse and do something he didn't like, he would tell security not to let you in.  Also, I don't think you would be able to get a sign past security unless it was hidden under your shirt or jacket.  I think that some kind of FIJA related protest would be a very good idea.  The tough part would be to pull it off effectively.

Dave Ridley

<<he would tell security not to let you in.>>

that's like telling mike fisher some cops might stop him from manicuring....

however keep the critiques coming in

d_goddard

Dada,

I would suggest that in the press release you include the following (feel free to edit as you see fit, of course):

This year, the New Hampshire legislature considered HB906, a bill which would have required juries to be informed of their inherent right to judge the law as well as the facts. At the public hearing on March 15, Associate Attorney General Richard Head testified before the House Judicial committee that jurors do indeed have this right.
