so is this 8/19 date a trail, pre-trial, plea entry?  is this the kind of thing that gets a jury trial or bench trial?

He has already entered a not-guilty : http://www.youtube.com/watch?v=L32-DPPyRyQ

He will be tried by the judge.

Hey Russell, did you ever schedule a public meeting with the "city clerk" about revoking your voter registration?
no .... I will try to register in Grafton and then maybe revoke it there.

FTL_Ian

I'm debating doing it in Keene for myself.  I'm almost 100% over voting.

Russell Kanning

it is a long hard journey my friend .... I have never ascended all the way to the summit :)

If you want to win your traffic case- listen to these audio files:

[things]

This is the problem with the courts. There are a million "legal" angles to take. But at the end of the day, the judge can say what he wants and you are "legally" held to it. I prefer the one, simple angle of: "I didn't hurt anyone; I don't owe compensation to anyone." I don't have the time to study legal procedure that can invalidate a case.

Yeah: K.I.S.S. [Keep it simple stupid].

In N.H. the first offense for driving without a license is a violation (fine-only offense), and then elevates up to a misdemeanor (jail time possible for a Class A rather than B) for a 2nd and any subsequent offense(s), the latter "they" say is the ONLY time you're eligible for to claim a trial by jury, but that these judges do take an RSA Ch. 92:2 oath of office http://www.state.nh.us [click on the statutes chapter in the left margin if you'd like to read this], and that includes the const. of the United States, including Art. III, Sec. 2, Clause 3 in that "The trial of ALL such Crimes, EXCEPT in Cases of Impeachment, SHALL be by Jury" (emphasis ADDed for all meaning at the 100% level, with the ONLY exception being for Impeachment, and so MUST be by jury as the mandatory requirement) because this IS a CRIMINAL case, not CIVIL!

Furthermore, if you've never been in an accident, see the Oregon Law Review of December 1953 @ page 1 that I used in court to win my case #83-S-313 by nol pros at the Merrimack County Superior Court in Concord back in 1983 after George Gordon and his wife from "The School of Common Law" came to visit us here in N.H. from Boise, Idaho in his motor home withOUT license plates, with this information and more. When I put this info into a Motion to Dismiss, it was if effect granted because they did not want to set a precedent. The summary is that: A license is a restraint on the individual when you're a proven threat to the public, and you're NOT a proven threat until AFTER your first accident.

Good luck Russell, - - Joe

P.S. Over to here beyond the "Ed Brown" chapter since my Reply #7647 on page 510 over at http://nhunderground.com/forum/index.php?topic=3868.7635 IN SEARCH OF...help to clog the parking lot at Federal Senator Judd Gregg's Concord Office on Tuesday afternoon @ 3-5 p.m. if you're interested and willing to help at that time the supper is on me at the Safety Patrol Picnic in Rollins Park 5:30-7:30 p.m. (see poster at Concord City Library Bulletin Board) to any and all drivers. Me trying to get Gregg to merely "endorse" my complaint of investigation of the illegal payout from Judge Jeffrey R. Howard's office (he used to be our N.H. A.G.) to those illegal pre-trial hearings in Maine against 18USC3232 that reads for "all" proceedings, not just the trial to be in the "district" of where the alleged crime occurred, and so to help Bob, Jason, Reno and Danny to have their attorneys motion for a new trial based on this violation of procedural due process of law, as the end dopes not justify the means!

PPS If no endorsement that day, then maybe a re-visit on Thursday before and after 11:00 a.m. - 1:30 p.m. when Eames Insurance and Real Estate on the Heights in Concord, on Airport Road going south from Wendy's is having their every Thursday BBQ all Summer long, with the public invited per the poster I saw at the Lincoln-Mercury dealer on Manchester Street, and have attended two cook-outs so far: for free hamburger, chips +/or french fries and a can of soda. Talk real estate too, as in to find some cheap land for a jeep trail to an affordable housing, per the grandfather clause in RSA Ch. 674:41,I(e) of 2004 for Class VI and private roads built BEFORE Zoning, and "Restricted" to one building lot up to the MAXIMUM # of lots on such a road, NOT to "prohibit", as I've indicated in my case against The Town of Boscawen, see their Town Files for my NOTICE OF CLAIM FOR ADMISSIONS on this is you want to tackle a case in another Town. They REFUSE to answer my 12 questions: of Do You Admit...? and so prima facie evidence.

Is anyone planning on doing the video for this?

Coconut

Fine with me. I'll give them another call. I'll probably have been up nearly all night though since I'm brining my sister to the airport at about 2am :p.

Coconut

last time she got angry at me for not being clear that I was from the press etc. Once it was cleared up though I was just given the OK. This time I said everything clearly, about 2 times, before she passed me off to another lady that I have to repeat all the information to.

Russell says he's going to show up for court without being dragged there, but if they want to give him jail time, they'll have to drag him away.
