BTW, there was 1 freestater who refused to take a hat off in court, the other one just asked a question outside the courtroom.

Ok so it would seem that because this wasn't right after a competition then USADA would not have tested him.  USA Swimming probably had the option but figured the photo was good enough... & if they would have tested him they may have been obligated to suspend him longer & with him expecting to swim through the 2012 olympics maybe they decided not too.
