Eyewitness to Corruption at its finest

I challenged a speeding ticket in Montana. What a sad joke the entire experience was for me. Of course I lost as the deck is stacked against me and anyone else who tries to battle the monsters.

First off, they would not give me a trial by a jury of my peers, only a trial by judge.

The judge would not let me speak when I brought up constitutional rights. He cut me off everytime I brought up 6th amendment rights, etc.

I pushed him hard(verbally) several times and he threatened me with contempt of court.

He finally was pissed off so bad he told me (and these were his words)," This is my court, my rules." GRRR!

This corrupt SOB let the cop who issued me the bogus speeding ticket be his own prosecuter and witness. I cannot tell you how many things the judge accepted as fact by his testimony (without any evidence). I objected to everything the cop(witness) was doing wrong,  yet the judge overruled everytime. It made my stomach turn.

He dismissed everything I said and would continually ask me for my evidence (research etc) to back my statements. I asked him why he accepted the cops facts as truth (without eviidence) and not mine. It lectured me and said I insulted him. He threatened me again with comtempt.

I put a lot of time, heart and soul into researching how to effectively present my case and I truely thought I would kick ass. 

I was railroaded from the moment  I walked through the doors. The cop and judge were good buddies all the way through. What a fine display of corruption.

I had to do it because I thought I had a chance. Man, was I wrong. They must be still laughing at me. Bastards!

btw, the word must have got out that I was a juicy case as there were over 6 cops behind me when I left the courtroom. There was no one left in the courtroom but them.

I am glad I did it even though I got my ass kicked. Kangaroo Court.

It was also interesting that they called me last when no one else was in the courtroom. They had me tagged as "trouble" because of my previous appearence when I scheduled the trial and argues for a trial by jury. 

I asked for a transcipt of the trial and plan to post it online if anyone is interested. I am curious to see if they edit the judges statement when he said "my court, my rules."

I'd love to see the transcript.  Maybe there is an appealable issue.

business as usual unfortunately.  Sorry it didn't work out for you.  Until someone steps in to take it from him, that judge does own that court, that piece of public property.

and it's bullshit.

you can not pay and see what happens next, but I think you know what will happen.  If you don't pay, you win.  You might also go to jail, which is also a win but might not be good for your personal life.  Let me know if I can be of any help to you.

Littlehawk, just by forcing them to trial, you won. The fine doesn't begin to cover the cost of the judge and cops, plus you kept them busy so they couldn't hassle others during that time. That's the thinking behing NH-CLOG.

Sorry to hear it. Unfortunately, "This is my court, my rules." is standard practice and how courts work in America today. That's one of the reasons I don't believe the current system can be changed from within, only replaced.

Judges can do anything they want and get away with it. They can even send kids to prison without a fair trial and get away with it.

There had been hopes that, analogously, it might be decided that judicial immunity could not apply when there was no judicial discretion (that is, when the judge's decision had been purchased in advance, leaving no room for reasoned application of the law to the facts).

U.S. District Judge A. Richard Caputo rejected that argument, citing the U.S. Supreme Court's 1988 decision in Forrester v. White. In that case, the U.S. Supreme Court wrote that a judicial act "does not become less judicial by virtue of an allegation of malice or corruption of motive." Caputo added the U.S. Supreme Court's 1978 decision in Stump v. Sparkman held that the question concerning judicial immunity is not related to the intent of a judge or the extent of the judge's error.

Forrester involved an administrative act by a judge (firing someone because of her sex), so anything written about immunity for judicial acts was arguably obiter dictum. In Stump, the egregious action by the judge was committed without corruption. [He had granted a mother's petition to have a tubal ligation performed on her 15-year-old daughter, whom the mother alleged was "somewhat retarded," the same day that the petition was filed, and without a hearing to receive evidence or appoint a lawyer to protect the daughter's interests. The daughter underwent the surgery a week later, having been told that she was to have her appendix removed.] Justice White, speaking for the court, wrote, "A judge is absolutely immune from liability for his judicial acts even if his exercise of authority is flawed by the commission of grave procedural errors." White's decision did not explicitly hold that corrupt, purchased rulings were "judicial acts." I, along with other professors of Legal Ethics, anxiously await an ultimate appeal on these grounds to the Third Circuit.

Is because you believe in the government and have been brainwashed, by them to love the constitution?

You have rights that any judge can take away and the constitution will protect the judge, but not you.
