PROLOGUE

On March 23rd 2010, at approximately 1615 hours, members of the POP UNIT received information through an online website in regards to a protest for legalizing marijuana. On this website, the attendees have advocated the use of marijuana while protesting. The protest was located in the memorial area on Library Hill between Concord Street and Amherst Street. Officers Stone and Kucharski assumed the role of undercovers for this protest while Officer MacIsaac, I, and Sergeant Linehan maintained surveillance of the area.

After Officers Stone and Kucharski entered the group protesting, a short time later, Officer Stone advised that a white male subject wearing a green puffy jacket had handed him a hand rolled cigarette containing a green vegetative substance believed to be marijuana. Officer Stone seized this cigarette to be tagged as evidence while Officers MacIsaac, I, and Sergeant Linehan made our way to the area. On this day, we were in plain clothes with our badges clearly displayed on chains outside our shirts.

We then made contact with the male subject, whom we were only able to identify as Curtis "Last Name Unknown". We identified ourselves as Nashua Police Officers and escorted Curtis to our unit. Curtis was placed in handcuffs with his hands behind his back and placed in the rear seat of our unit. Curtis was transported to Nashua Drive where he was released to Officer Moores for transport.

It should be noted that Curtis refused to give any identifying information and was subsequently transported to Valley Street Jail. After booking, the substance was field tested and resulted positive for marijuana.

Curtis indicated to me that he had some, and then retrieved a zip lock bag from his right side jacket pocket. I observed the bag to have a large amount of what I believed to be tobacco. Curtis removed a rolled white paper cigarette from the bag and handed it to me. I asked Curtis fif the marijuana was real, and he replied that it was very good stuff. I asked Curtis "how much" he wanted for it and he indicated that he didn't want anything but to split it with me. Curtis then told me to light the marijuana up. I smelled the rolled cigarette and was able to positively identify it as marijuana.

At this time a marked Nashua Police Cruiser drove by. When the police cruiser drove by I ducked behind the sign I was holding and shielded myself from the cruiser. Curtis then continued to tell me to light the marijuana. I told Curtis that I had just seen another police cruiser down the street and will light it up in a minute. Curtis told me not to worry about the police and to do it anyways. A few minutes later I placed a phone call to Sergeant Linehan and told him that the male in the green jacket just provided me with marijuana.

A few minutes later Officer DiFava, MacIsaac, and Sergeant Linehan arrived on the scene. They approached Curtis and I indicated to them that this was the subject who had provided me with marijuana. Officer Difava(sic) and Officer Macisaac (sic) then placed him under arrest. Officer Kucharski and I continued to hold signs, until the remainder of the activists indicated that they would be traveling to the Nashua Police Department to continue their protest.

I responded back to the Nashua Police Department and tested the rolled marijuana. I utilized a NARCOTEST kit, which indicated positive reaction to cannabis. The marijuana was tagged as evidence per SOP and secured into the evidence safe. This ended my involvement.

BTW, I'm told that there is NO CASE HISTORY for this charge. This law has never been tested! Everyone convicted of this did so as part of a plea deal. Most who were charged with this were offered a lesser plea. No one has stood up and said NO.

Ok, next up is my May 5th Probable Cause hearing. Since I'm only just now able to secure legal counsel,

and the public defender's office STILL hasnt attempted to contact me, I'll be asking for another continuance.

I had a dispositional conference with opposing counsel today (or my counsel did).

All plea deals were rejected. Lance did a killer job talking to the judge.

The prosecutor uttered the words "he shouldn't serve one day in jail for this charge" in front of the judge!

The judge was totally cool, and will likely (or 50-50) be my trial judge.

Upon exiting the courtroom, I was informed by my counsel that the prosecutor would be filing a motion to amend to a lesser charge (class A misdemeanor possession)!

That motion was filed this afternoon (I've got a copy)!

This is now the FORMERLY Felonious Saga of Sovereign Curtis!

The trial schedule is the same as before, likely early/mid January.

Because I'm already at the Superior Court level, I can not appeal and get a "do-over" at/to the Superior Court. Any appeal goes to the State Supreme Court.

If you do a good enough job of preparing, they may be scared enough to drop the charges.

Nolle prosequi a day or two before trial is not uncommon anymore.  They get to harass you, but eliminate most of their liability by dropping (but not dismissing) the charges.

I have seen other people look forward to a trial ..... and then have the judge stomp all over them.

Ed Brown and Larken Rose both were looking forward to their trials and then hated the results.

It is their building, in which they use their rules and they will use force to get their way.
