Courtwatchers requested for Monday Tax Court case

I've got a trial before the United States Tax Court on Monday, 30 April. That's in the Thos.P.O'Neill Federal Building on Causeway Street in Boston at 10 AM.

I'm the petitioner versus the Commissioner of Internal Revenue, respondent.

At issue are:

1) my declining to be a numbered person because of my religious beliefs,

2) my declining to swear because of my religious beliefs, and, probably,

3) my practice of not visiting my troubles on other people because of my religious beliefs and conscience. IRS will want to know all people I have had as clients and all people I have subcontracted work to. It would be a violation of my beliefs and conscience by naming them. And, of course,

4) the amount of tax owed. I am willing to tell IRS what my revenues and expenses are in numerical amounts and to have them or others compute the tax they say I should pay.

Anyway, here's my need: a couple of observers to watch and take notes, and to drive my car home if the court finds my stand so disagreeable that they jail me for contempt.

We can have lunch in Boston afterwards, if all goes well, or...

Will a couple of Porcs be willing to join me?

Yeah, I know, I've been too busy to even announce this.

It's Shimek v. Commissioner of Internal Revenue. You have to sue them in Tax Court if you disagree with IRS's pronouncement in a letter of deficiency (90 day letter) - I didn't say I agree with it - this is just their process.

I came above their radar a couple of years ago and this is just one of the steps in the process that followed. The Tax Court is an Article I (administrative/executive) "court" that doesn't hear legal issues - just "what is the right amount?" issues. Actually I heard it was called the Board of Tax Appeals until FDR decided to call it a "court" to kind of elevate its status.

I have no hope of rocking the system and stopping conficatory taxation, or anything of the like. I just plan to maintain my beliefs and practices, based on my religious convictions. Not sure they're going to like that, but some of these battles have already been fought out before.

Have you found anyone yet? I just now saw this. I will gladly go if I can get a ride. Don can drop me off someplace. He usually heads down I93 as far as N. Andover between 8 and 8:30.

Yeah, my fault for not posting this earlier. I've just been depressed and stressed about it and working a lot to get Murphy's opened.

I haven't been checking or using the calendar - guess I should start doing that.

If you mean reporting by employers, for example, no. I am not employed - I'm a small businessman. In the Interrogatories, though, IRS has asked for information that I cannot, in good conscience, give. That's what they might not like.

Nope. Third-party reporting is when you force suppliers and service-providers to fill out a W-2 and send them a 1099 (with copies to the IRS) for the money you paid them.
