president, im not a lawyer, im a 3rd year law student. Normally I can not defend other people but myself unless working under the direction of an attorney, but NH has strange lenient laws to practice law without being admitted to the board under a few exceptions. So if Russell was just looking to save money and wanted advice I would do it. Since there is no possibility of jail time he would not be entitled to a public defender. In regards to jury nullification I am interested in it since I just finished a research paper on it.

Sometimes callers don't always know what they are talking about.  Never hurts to double check!

JonM

Channel 5 in Boston carried it as a blurb piece with video from WMUR (they're both ABC stations).

John

WMUR news @ 11 . . . Russell also got the teaser at 5 or 10 of  :) . . . coverage was almost as good as at 6  :) . . . L&F groups mentioned in Russell portion again  :o . . . story tied to Mike's (with F group  ::)) - well they have to use something to tie them together, and (IMHO) that's better than not doing so  . . . VERY clear NHfree.com sign for several seconds in Mike portion  8) . . .

A buddy had told his daughter several days ago about this coming up . . . she called him after seeing the teaser . . . she had not seen the Mike coverage before  . . . so all-in-all I'd say thumbs up to WMUR!

This session, SB156 has passed the House and Senate (awaiting the Gov's signature?  Will start 1/1/2006), raising the bar to a felony for future offenses:

http://generalcourt.org/bills/2005/SB156-FN/text

AMENDED ANALYSIS

This bill establishes criminal trespass as a misdemeanor for the first offense and as a class B felony for any subsequent offense if a person knowingly or recklessly causes damage in excess of $1,000 to the value of the property of another.[/b]

It appears future offenses are only a felony if a person knowingly or reclessly causes damage in excess of $1,000.

"You disrupted the airport workings, causing us to halt scheduled flights, pay various costs, and much more... the cost to us was over $1,000.  Since you 'knowingly' disrupted things, we're seeking a felony."

It's VERY easy to have damage claims, especially if you've got authority on your side and government bureaucracy to support...

Also, if he claims innocence, it's a Class B Misdemeanor anyways, so there will be no jury trial.
I did a little research, and have found cases where criminal trespass has been a Class B misdemeanor, Class A misdemeanor, or a violation.

From what the deputy chief told me, they had a choice of what to charge him with, and since he was being so pleasant after his arrest, they did class B instead of A.  I don't think they could have picked the violation and still got rid of him.

John

I think Russell must be one of the most pleasant people in the word.

I can just see those authority boys scratching their wooden heads tonight thinking about what a pleasant guy they met today - and thinking, hey I though we were supposed to be arresting bad guys.? What ever became of us?

Well, one can hope!

'Sokay, Alan. It's only offensive if it's intended to be.  ;)

While the TSA types probably aren't receptive to the notion that their authority and the law could actually be wrong (being all full of themselves, newly promoted from Mall Security to Oh-fishul Fedrull Ossifer), the Rockingham deputies and jailers are probably a bit more old hat. RCSO might have some rookie Tackleberry types, but I'm sure most of the non-TSA folks that Russell encountered are not just polite, but mostly sympathetic.
