I just cannot believe they ARRESTED her for not having a DL.

Although I disagree with her personal beliefs about not needing a DL, the fact that the police actually ARRESTED her? Shit, as screwed up in NJ as we are, you don't get ARRESTED for driving without a DL.

Sounds like the Police have alot of free time on their hands...

Nice job with the use of the phrase "right of way" in your explanation to the peace officers of what your rights are.

Freedom of speech, assembly, petition, travel/movement are done within the right of ways contained within the collectively owned sidewalks and roadways. You have to keep moving while exercising those rights and you can't walk three abreast on the sidewalk otherwise you potentially infringe on the individual equal rights of others.

The farther away one gets from foot travel (skateboard, bike, horse, car) on these common right of ways within collectively owned property (sidewalks/parking lots/roads) the more the state treats the rulemaking for collectively owned property as superior over the narrow role for policing infringement on common right of ways which they treat as inferior.

She was charged with speeding, driving an unregistered vehicle, having a suspended license, disobeying an officer, and resisting arrest. That's certainly enough excuses for them to arrest someone.

By the way, just to set the record straight, the police handled themselves in a very professional manner.

Jim loaned me his tape to edit and post. I have to take and condense 40+ minutes of footage into something less than 10 mins.

I do not think police handle themselves in a professional manner when they violate God given rights and Constitutional rights.

It is like saying " Oh yeah they killed my brother but acted very professional about it."

Just doin their jobs huh?

I thought their job was to uphold the constitution...seems like we need to re-eval their job description. I think taking an oath means something though doesn't it? And if they do not honor that oath it is treason..and punishable how?

I don't see this as a Constitutional issue, unless you mean of course state Constitution.

The reason being is that the federal Constitution gives states any power they so choose not specifically prohibited by the Constitution.  And car registration etc are all state level laws are they not?

That's not to say they are good or bad laws, I'm only stating that this isn't a federal issue... it's a state level issue.

The police moved to arrest Lauren after she did not show them government papers.  Disobeying an officer and resisting arrest is the bull crap they add on after she was placed under arrest.

are there specifics to the "disobeying an officer" charges?

ie..take your pants off... get out of the car..spit out your gum... is your wife good in bed..etc

and then if you refuse to answer ( exercise the 5th amend.) (probally what lauren did), can they still charge with this "disobeying" bullshit. If one chooses to use the 5th amendamnet it should be honored and thus is no reason to arrest for "refusing/disobeying an officer request".

what are the guidelines if any? Does this fall under "reasonable"? I ask because this seems like the easy way out for gooncops to carry you off to the gulags. The other one is "you are on provate property". It seems everything is now "private property"

in my opinion throwing someone like lauren in jail with handcuffs and shackles should be against the law. Maybe we should break her out and she can go on the lamb .lol

my understanding of having rights vs. privileges is that when you get a license you give up your Rights in favor of the privilege. therefore must follow the laws and statutes related to the license.
even though you didn't know you were giving up your rights, you do so voluntarily. i have read that there is a way to give back the driving privilege that involves surrendering your DL back to them, among other things. but it must be in good standing , ie.. not suspended.
